名和総長を辞めさせるという結論ありきでの、北海道大学および総長選考会議による不当な解任手続きにより、名和総長本人の基本的人権が侵害されている事実に対して、人権保護の観点から「不当解任」申し出の即時却下と「本人および弁護団が認めていないパワーハラスメントの公報による名誉毀損」に対する回復を訴えます。

 

具体的な訴えは、以下の通りです。

①一方的な解任申し出の判断：

　大学や総長選考会議が、パワーハラスメントの証拠や詳細を名和総長本人および弁護団にもほとんど開示せず、対等とは言えない状況で一方的に解任要求の結論を出していること。（開示された中にはパワハラと認定できる事実は無いことを弁護団が確認）

②不十分な調査：

　総長選考会議が設置した調査委員会では、名和総長本人および弁護団に対する聴取や無実を訴える機会もなく、解任申し出を決定するまでの手続きが一方的かつ不当であったこと。

③不透明な過程：

　大学側は解任申し出の結論を出しているにも関わらず、その詳細や過程を名和総長側だけでなく、学内や社会に対しても開示していないこと。（名和総長側や、北大教職員組合等からも再三開示要求があったが、２０２０年２月現在も説明は無いままである）

④不当な復職拒否：

　解任が正式に決まっていない段階で、大学側は明確な説明もなく、法的な根拠もなく、名和総長の復職を拒んでいること。

⑤対応の不足：

　文部科学省に対して、大学側へ証拠資料の開示等をするように指導することを、再三求めたが、実現していないこと。

 

　皆さんが、もし身に覚えの無いパワハラで、説明も証拠もほとんど明かされないまま、正当な場での反論の機会も無いまま、解雇されたとしたらどう思いますか？そしてそれを社会に公表されたとしたら…、個人の立場で考えると恐ろしいことです。現状では、皆さんが判断するための情報さえ開示されないまま、名和総長の解任申し出がなされており、“パワハラ”という言葉の印象だけで結論を決めつけられかねない事態となっております。

 

　しかし情報開示が無ければ何も判断できないことから、まず私たちは大学側に速やかな情報開示や説明を求めます。そして、公平・公正に互いの主張を訴えることができ、正当に評価されることを望みます。

 

　名和総長の不当解任申し出に反対される方に加えて、大学や総長選考会議の不透明なやり方に反対される方、少しでも疑問を抱かれた方は、署名をお願いいたします。

なお、署名には名前、メールアドレス、郵便番号、市町村の入力が必要ですが、署名内容については、提出先の文部科学省以外には公開いたしません。

署名活動への多大なご協力をいただき、誠にありがとうございます。

しかしながら先日、大変残念なことに文部科学省・北大より名和総長の解任の発表がありました。しかし、両発表とも、明確な事実に基づく説明がなく、漠然とした内容で納得できるものではありません。文部科学省には、「どのような適切な調査が行われ、それによりどんな事実や証拠が明らかになり、それらに基づき、どう公平に論理的に判断されたか」を、今後明示していただきたいです。

【Protest against the unfair dismissal of Hokkaido University President Nawa and appeal for regaining his honor】

The specific appeal is as follows.

(1) The university and the Presidents' Selection Committee have hardly disclosed any evidence or details of power harassment to President Nawa and the lawyers, and have unilaterally concluded a request for dismissal. (2) The Power Harvesting Investigation Committee did not have the opportunity to hear the President Nawa and the lawyer or to complain of innocence, and the procedure before deciding to dismiss was inappropriate.

(3) Although the university has concluded the dismissal request, it has not disclosed details or processes to the university or society. (Repeated disclosure requests have been made by President Nawa and the Hokkaido University Staff Union, but no explanation has been given as of February 2020.)

(4) Despite the fact that the dismissal has not been officially decided, Hokkaido University has illegally refused to reinstate President Nawa without a clear explanation.

(5) The Ministry of Education did not provide appropriate guidance to Hokkaido University on information disclosure.

 

What do you think if you were fired in a power harassment you couldn't remember, with little explanation or evidence, and no opportunity to refute in the right place? And if it were made public, it would be terrible from an individual perspective. At present, President Nawa has been requested to be dismissed without giving you any information to make a decision, and the impression of the word "power harassment" alone may make it impossible to determine the conclusion.

 

First, we ask the university to promptly disclose information about dismissal of President Nawa and explain its reasons. And we hope that President Nawa and appealing persons can appeal each other's claims fairly and fairly and that they will be evaluated fairly.
