Dear Sir/Ma'am

It is concerned with the death of a pregnant elephant after a local fed her a pineapple stuffed with crackers in Malappuram, Kerala. I want to request you all to take strict actions against the culprits who are responsible for the brutality done with Elephant in Kerala. I am filing this petition because this is a cruel, inhuman act with animals.

I want to add that this kind of activity needs robust appraisals and actions from the government so that in the future, we can avoid these shameful acts of inhumanity.

Law & Order need to be very strict, I know that the family of that pregnant elephant is not going to drag the culprit to the court for Justice, but as a responsible citizen of India, we are responsible for maintaining peaceful living in harmony with nature.

According to Law, It is a cognizable offense under Section 428 and Section 429 of the Indian Penal Code. Section 428 of the I.P.C. deals with the punishment for committing mischief by killing, poisoning, maiming or rendering useless any animal or animals of the value of ten rupees or upwards. The punishment for such acts/offenses is simple or rigorous imprisonment for a term, which may extend to two years, or with a fine, or with both. While Section 429 of the I.P.C. deals with the punishment for the same nature of the crime, but for the animals of the value of fifty rupees or upwards, it must be immediately lodged as an F.I.R. with the area police station. The punishment, in this case, will be imprisonment of either description for a term, which may extend to five years or with a fine, or with both. As per Section 11 of Prevention of Cruelty to Animals Act,1960, beating, kicking,over-riding, overloading, over-driving, torturing, or otherwise treating any animals to subject it to unnecessary pain amounts to cruelty on animals. And whoever indulges in the act of cruelty to animals makes himself liable for action under the Prevention of Cruelty to Animals Act.

At last, I want to conclude by mentioning that I am not a law expert or any activist. I am a citizen of India, and the act of inhumanity is much more brutal then the brutality explained in the laws. I, on behalf of humanity, request all the officials that this needs to processed with priority, and Justice needs to be delivered to those poor souls.
