自民党・杉田水脈衆議院議員による「女性はいくらでもうそをつけますから」との発言に、断固抗議し、謝罪・発言撤回、議員辞職を求めます。これは性暴力被害者を貶めるセカンドレイプであり、激しく性差別的であり、性暴力根絶に向けて取り組む動きを後退させかねないヘイトスピーチです。

私たちは2019年3月に相次いだ性犯罪の無罪判決をきっかけに、性暴力の根絶、性暴力被害者との連帯を求めフラワーデモをはじめました。現在、全国47都道府県で毎月11日にデモが行われています。

フラワーデモのきっかけとなった4件の無罪判決のうち2件は、実父から娘への性虐待でした。12歳の娘への性虐待の容疑で起訴された父親は児童ポルノ所持で罰金刑がつきましたが、娘への性虐待の容疑は「被害者の証言は信用できない」「家が狭いのに他の家族が気がつかないのはおかしい」とされ無罪判決が下されました(現在高裁で審理中)。

この社会で、女性の意思や声は軽んじられ、被害を受けた側の声が疑われ、「女性として」の振る舞いを問われ、自己責任を突きつけられ、「男性の人生を破滅させるのか」と糾弾されてきました。12歳の女の子であれ嘘をついて成人男性を貶めることができるのだ、という意識を法曹界の成人男性が持つほどに、性暴力は理解されず、被害者の言葉は潰されてきました。性暴力を許してきたのは社会の性差別です。

フラワーデモでは多くの女性たちが自らの被害を人前で語りはじめました。「誰にも話せなかった」と被害を語る声が伝えるのは、被害者は「語れない」のではなく、語ってもどうせ信じてもらえない、という諦めを強いられてきた過去でした。証拠もない、目撃者もいない、しかも相手は社会的地位が高かったり、また実父であることも決して珍しくない。たとえ声をあげられたとしても警察で門前払いをされた被害者は少なくありません。刑事事件として裁かれる性暴力は、氷山の一角に過ぎない。聞かれることも、裁かれることもなかった性暴力被害の声を通して突きつけられるのは、被害者は語れなかったのではなく、社会が語らせなかった、信じようとしなかった、聞く力がなかった残酷な事実です。

2019年3月に無罪判決が出された4件の事件のうち2件は、高裁で有罪判決が出されました。どちらも一審で無罪の根拠とされた事実が、2審では有罪の根拠として示されるという劇的な判決でした。

例えば娘を長期に渡り性虐待していた実父の事件(名古屋高裁)は、「被害者が普通に日常を送っていたから無罪」とされたことが、「日常を普通に送らざるをえないことそのものが被害者の現実である」と覆りました。そのような結果が出された背景には、1年にわたり被害者が声をあげ続け、ジェンダーセンシティビティを法曹界に求め続け、メディアが性暴力問題を果敢に報道し世論が変わりつつあったことがあります。国際社会でも#MeToo運動の興隆により、被害者に寄り添う被害者中心主義が求められています。

杉田議員の発言は、弁解の余地ないセカンドレイプ、ヘイトスピーチであり、国際社会の水準からも性暴力に対する認識が著しく遅れている性差別です。日本はジェンダー不平等の指数が153カ国中121位です。ジェンダー不平等を改善すべく努める国会議員が、率先して性差別的発言を行い、性暴力への無知を露呈することは許されるべきことではありません。杉田水脈氏には発言の撤回・謝罪、そして議員辞職を求めます。

We hereby demand that LDP House of Representatives member Mio Sugita withdraw her statement, issue a public apology, and resign from her position.

We strongly protest against LDP House of Representatives member Mio Sugita's statement on "women can tell lies as much as they want," and demand that she withdraw her statement, issues a public apology, and resigns from her position.Her statement has resulted in the "second rape" of victims of sexual violence and constitutes sexual discrimination. It is also considered hate speech that could hamper efforts to eliminate sexual violence.

We have launched “Flower Demo” in March 2019 with the aim of eliminating sexual violence and building solidarity with victims of sexual violence in the aftermath of a series of acquittals for perpetrators of sexual crimes. Currently, demonstrations are being organized on the 11th of every month in all 47 prefectures nationwide.

Two of the four acquittals that had triggered the launch of Flower Demo involved sexual abuse of daughters by fathers. Although one of the perpetrators charged with sexually abusing his 12-year-old daughter was ultimately fined for possessing child pornography, his sexual abuse charge was dismissed on the grounds that "the victim's testimony was not credible." (Proceedings for this case are currently underway at the High Court.)

The will and voices of women are often neglected in our society, where women are required to behave according to stereotypes and any claims made by victims of sexual violence are usually met with skepticism. When such claims are made, the victims are often accused of attempting to ruin a man's life.
Sexual violence is not taken seriously and the words of victims are often ignored. Even a 12-year-old girl can be thought to have lied to bring down an adult man. It is the sexual discrimination inherent in our society that has allowed sexual violence to fester.

Flower Demo has empowered many women to take to the streets and start giving voice to the past experiences that they have suffered. What became clear was that it is not the case that victims are unable to speak out, but that they have been compelled to stay silent because no one would believe them even if they had spoken out. In many cases, there was no hard evidence to be presented to the police and no witnesses. Moreover, perpetrators of such crimes often have a high social status, and it is not uncommon for some of them to even be fathers of the victims. Many victims had not been taken seriously by the police, and the cases of sexual violence that have been trialed in court represent nothing more than the tip of the iceberg.
The voices of victims of sexual violence have exposed the cruel reality that it is not the case that victims are unable to speak out, but that our society has been unwilling to listen to them.

However, our society is changing.
In two of the four cases from March 2019, the initial acquittal was eventually reversed by the High Court and the perpetrators were convicted. In a dramatic shift, the facts that had been taken to be proof of the defendants' innocence in the first instance were later determined to be proof of their guilt upon appeal in both cases.
These changes were only possible because of the actions of victims of sexual violence and social movements that have continued to advocate for gender sensitivity within the legal community, as well as media organizations that have actively reported on issues of sexual violence and the backing of public opinion. With the rise of the #MeToo movement within the international community, there is an increasing willingness to hear out the victims and stand in solidarity with them.

Sugita's statement is inexcusable hate speech that constitutes a form of "second rape" of victims of sexual violence and which seriously falls short of the sensitivity demanded by the international community with regard to the problem of sexual violence.
Japan ranks a lowly 121st out of 153 countries in the Global Gender Gap Index. Parliamentarians who ought to address gender inequality must not be allowed to set the wrong example by issuing sexually discriminatory remarks and revealing their ignorance of the very real problem of sexual violence. In view of this, we demand that Mio Sugita withdraw her statement, issue a public apology, and resign from her position.
