BACK TO WORK DAY DECLARATION

WE ARE American men and women, who believe that our nation was founded upon the principle of liberty;

WE ARE business-owners, proprietors, franchisees, entrepreneurs, employees, and contractors;

WE ARE taxpaying members of our communities;

WHEREAS, the Constitution of the United States guarantees that no person shall be denied life, liberty or property without due process of law;

WHEREAS, the Constitution of the United States guarantees Freedom of Contract and prohibits government actions from impairing that freedom;

WHEREAS, private sector business, through its revenue creation and its employees, is the engine that powers the American economy by providing honest pay for honest work and enabling generations of Americans to support their families, save for the future, and invest in their well-being;

WE ARE MINDFUL that there has been a worldwide outbreak of a new strain of the Coronavirus, COVID19, for which there is at the present time, no vaccine, and which like many other illnesses is contagious and has proven fatal in some cases;

WE ARE MINDFUL of the need to protect society against the rampant spread of this virus, and against all communicable diseases, including taking greater caution to protect the elderly, infirm and most vulnerable;

WE ARE MINDFUL ALSO that as of the date of this drafting, approximately one-tenth of one percent of Pennsylvania’s population has tested positive for COVID19, and of that total, less than two percent have lost their lives, AND in the United States as a whole, approximately twelve percent of the population has tested positive for COVID19 and of that total less than one-tenth of one percent have lost their lives, AND that the majority of those who lost their lives across our Commonwealth and across our country were in pre-existing fragile states due to prior health conditions;

WE ARE MINDFUL ALSO that all projections used and relied upon by government policy-makers to establish mandatory business closures, quarantines and stay home orders, have been grossly overstated and have proven within a matter of weeks, to be inaccurate by an order of magnitude;

WE BELIEVE that any actions taken to protect society against the spread of this virus, due to the economic and social disruption and damage those actions may cause, must be limited in duration and scope to that which is reasonably necessary to protect the public AND that any actions taken to protect society must be based upon a careful weighing of not only medical and scientific factors and probabilities, but ALSO economic and social factors and probabilities as well as adverse and unintended but foreseeable negative consequences;

WE BELIEVE that every business, to its owners, proprietors, and employees, and to the extent that it contributes to our local, state and federal government’s tax base, is ESSENTIAL.

 

WE THEREFORE RESOLVE and DECLARE:

I. All of the government-imposed rules, regulations, and laws regarding business closures and public social interaction should be followed throughout the month of April 2020.

II. On Friday, May 1, 2020, WE WILL GO BACK TO WORK, subject to the terms and conditions outlined herein below.

III. The undersigned business-owners, proprietors, contractors and employees agree to the terms and conditions of the following:

BACK TO WORK PLEDGE:

  1. We will open our business for work and commerce on May 1, 2020.
  2. We will maintain social distancing within our place of business requiring all employees and customers to maintain a minimum of six (6) feet of distance between each other for a minimum of thirty (30) days.
  3. We will ensure that all surfaces involving customer contact at point of sale locations are wiped down with disinfectant in between each transaction.
  4. We will ensure that all public restrooms are kept under lock and key, to be used only by request and disinfected after each use.
  5. No employee who has tested positive for COVID19 or has displayed the symptoms shall attempt or be permitted to return to work until medically cleared.
  6. Prior to opening for business and after the close of business each day, we will ensure all surfaces are disinfected.
  7. We will limit the capacity of customers, clients, and/or shoppers within our place of business to ensure that a minimum of six (6) feet of space between all persons is possible at all times.
  8. Stores that offer personal services shall adhere to all guidelines above and also ensure that they:

    • Ask customers whether they've shown any of the Coronavirus symptoms

    • Require employees to wash their hands before and after delivering services

    • Keep a list of clients who have used your business

    • Ensure all clients and staff follow social distancing guidelines

    • Require clients and staff to wear masks or full-face shields where appropriate

    • Staff must wear gloves and discard them after service

    • All cashiers must wear gloves and face masks

    • and At all times we must use common sense to ensure staff and customers are protected

IV. We hope that government authorities will cooperate and revoke any and all mandatory business closures effective May 1, 2020, but we will abide by this PLEDGE and RETURN TO WORK on May 1, 2020, regardless.

V. If any business closure order remains in effect, we will not engage in any acts, displays or threats of violence toward any law enforcement employee, or state, local or municipal regulatory employee in the event that an inquiry is made or any enforcement action is attempted or threatened; we will cooperate with any such persons, but we will NOT however voluntarily shut down our business or dismiss any of our customers, clients or employees.

VI. We will abide by all laws, rules, and regulations pertaining to our business or employment as we would under any ordinary circumstances.

And for the support of this Declaration, with a firm reliance on the protection of Divine Providence, we mutually pledge to each other our Lives, our Fortunes, and our sacred Honor.

Knowing the risks, WE THE UNDERSIGNED, mutually pledge to each other to exercise our sacred right to work and livelihood.
