Update from Nikki’s Community Defense Committee, October 2021:

It’s time for Nikki to come home. We’re calling on New York Governor Kathy Hochul to use her executive clemency power to give Nikki back to her two young children, who desperately need her. Background:

 

Nicole “Nikki” Addimando is a victim of domestic violence and rape who was wrongfully prosecuted and convicted in April 2019 of second-degree murder after shooting and killing her abusive partner out of fear for her life. On February 11, 2020, she was given a horrific and unjust sentence of 19-years-to-life by Judge Edward T. McLoughlin in Dutchess County, NY. She is separated indefinitely from her two young children, ages 8 and 6.  She is a loving mother, friend, sister and daughter. Her community longs to bring her home to where she is loved and can heal.

 

Nikki’s appeal was filed with the state of New York State Court of Appeals, and in June of 2021, the higher court determined that Nikki was a victim of abuse and should have been sentenced under New York’s DVSJA law, and issued a scathing rebuke of the trial court’s “arcane” and “antiquated” beliefs and methodology. They resentenced her to 7.5 years.

 

 

 

While 7.5 years is a significant improvement, we maintain that Nikki shouldn’t have spent a single day behind bars and should be released immediately. Her children shouldn’t have to wait 3 more years of their young lives. She has a wide net of support, ready and waiting to help her heal and transition back into society.

On Tuesday, Nicole “Nikki” Addimando was sentenced to 19 years to life in prison for killing her abuser in self-defense. Judge Edward McLoughlin chose not to take into account the years of life-threatening physical and sexual abuse, which was documented in official police reports and medical records. He denied applying the Domestic Violence Survivors Justice Act for a lesser sentence. Despite her abuser’s multiple threats to end her and her children’s life if she fled, Judge McLoughlin felt Nikki “could’ve safely left.” We sat in on the sentencing and listened to Nikki give a powerful, personal statement:
