We write to you as a group of Hong Kong citizens and/or French nationals who are concerned about the political crisis unfolding in Hong Kong. In light of Chief Executive Carrie Lam’s leadership in pushing an extradition bill that will gravely endanger the human rights and political freedoms of the residents in and travellers to Hong Kong, we ask that you revoke Ms. Lam’s distinction as an Officer of the Legion of Honor.

The Legion of Honor, one of France’s highest awards, recognises individuals of exceptional merit who have upheld or contributed to France’s national ideals of liberty and equality through their public service. The Fugitive Offenders and Mutual Legal Assistance in Criminal Matters Legislation Amendment Bill, as it is officially known, contradicts those ideals. Under this Bill, Hong Kong citizens and foreign nationals will be at risk of being sent to Mainland China to face the criminal justice system there, where they will not have a fair trial. Many countries including the US and Germany have expressed concerns over the Bill and its implications for the safety of their nationals working, travelling and living in Hong Kong. Yet despite opposition and deep concerns raised by the Hong Kong Bar Association, the business community, and most importantly, 1.03 million Hong Kong citizens who demonstrated against the bill on June 9th, Ms. Lam has continued to push the bill through, ignoring standard procedures of public consultation and reneging on her initial promise to serve as a Chief Executive that “connects” with her citizens.      

Furthermore, Ms. Lam’s handling of the dissent surrounding the bill has been widely condemned. The European Union and Amnesty International have both criticised the excessive force employed by the Hong Kong Police in cracking down on a largely peaceful protest on June 12th. The EU in particular has urged Ms. Lam’s government to respect Hong Kong citizens’ fundamental rights to assemble and express their views. Despite this, Ms. Lam’s government has continued to place the designated areas for peaceful assembly at the Legislative Council under police lockdown, and aims to force the bill through in the coming weeks.

We understand that Ms. Lam was made an Officer of the Legion of Honor in 2015 for her civil service record and her contributions to support French presence in Hong Kong. However, we believe that Ms. Lam’s leadership in pushing a controversial extradition bill that would endanger the human rights of Hong Kong residents and French nationals in Hong Kong, and her government’s violent suppression of peaceful dissent, should disqualify her from continuing on holding this distinction. Whatever her past record may be, she is clearly no longer the “model government leader and civil servant” that the Consul General of France, Arnaud Barthélémy once praised her as. Her actions as the Chief Executive of Hong Kong have gravely undermined, rather than contributed to, the French national ideals of freedom and equality for all. As such, we ask that you revoke Ms. Lam’s distinction as an Officer of the Legion of Honor.

Nous vous écrivons en tant que citoyens de Hong Kong et/ou ressortissants Français qui sommes préoccupés par la crise politique qui se déroule présentement à Hong Kong. Compte tenu du rôle de leadership exercé par la chef de l’exécutif Carrie Lam pour faire adopter un projet d’extradition qui risque de mettre en danger les droits et libertés des résidents et des visiteurs à Hong Kong, nous souhaitons que vous révoquiez le titre d’officier de la Légion d’honneur de Mme Lam.

Les décorations de la Légion d’honneur, distinctions parmi les plus prestigieuses de la France, récompensent des individus de mérite exceptionnel qui ont défendu ou qui ont contribué aux idéaux français de liberté et d’égalité dans leur service public. Le projet d’amendement de la loi sur l’extradition (Fugitive Offenders and Mutual Legal Assistance in Criminal Matters Legislation Amendment Bill) contredit ces idéaux. Après l’adoption de cette loi, les citoyens de Hong Kong et les ressortissants étrangers à Hong Kong risqueront d’être extradés vers la Chine continentale pour faire face à un système judiciaire qui ne leur donnera pas accès à un procès équitable. Plusieurs pays, dont les États-Unis et l’Allemagne, ont exprimé leurs inquiétudes face à ce projet de loi et ses implications pour la sécurité de leurs ressortissants qui travaillent, voyagent ou vivent à Hong Kong. Pourtant, malgré l’opposition et les profondes préoccupations soulevées par l’association du Barreau de Hong Kong, par le milieu des affaires et, de façon plus importante, par les 1.03 millions de citoyens qui ont manifesté contre le projet de loi le 9 juin, Mme Lam s’obstine à faire passer son projet en faisant fi des procédures habituelles entourant les consultations publiques, et manquant à sa promesse de servir en tant que chef de l’exécutif « en contact » avec ses citoyens.

De plus, la gestion par Mme Lam de la contestation entourant le projet de loi a été universellement sanctionnée. L’Union européenne et Amnistie internationale ont toutes deux critiqué l’emploi excessif de la force par la police de Hong Kong dans leur répression d’une manifestation largement pacifique le 12 juin. Notamment, l’Union européenne a exhorté Mme Lam à respecter les droits fondamentaux de réunion et d’expression des citoyens de Hong Kong. Néanmoins, le gouvernement de Mme Lam a continué de restreindre l’accès aux espaces du Conseil législatif consacrés à la réunion pacifique, maintenant sous contrôle policier, et vise toujours à forcer l’adoption du projet de loi dans les semaines à venir.

Nous comprenons que le titre d’officier de la Légion d’honneur a été octroyé à Mme Lam en 2015 pour sa carrière dans la fonction publique ainsi que pour sa contribution à la présence française à Hong Kong. Cependant, nous croyons que les efforts de Mme Lam à faire adopter ce projet de loi d’extradition controversé, qui met en danger les droits des résidents de Hong Kong et des ressortissants Français à Hong Kong, ainsi que la répression violente de la contestation pacifique par son gouvernement, méritent qu’on lui retire cet honneur. Peu importe son bilan passé, elle n’est visiblement plus la « leader et fonctionnaire modèle » dont le Consul général de France Arnaud Barthélémy a fait l’éloge. Ses actes en tant que chef de l’exécutif de Hong Kong ont gravement affaibli, plutôt que consolidé, les idéaux français de liberté et d’égalité pour tous. C’est pourquoi nous vous demandons de révoquer le titre d’officier de la Légion d’honneur de Mme Lam.
