Fundamentalmente la propuesta de #Fiscal_Digital busca que el Papel Carbón (tecnología inventada en 1801), utilizado por las Juntas Receptoras de Votos-JRVs (Voluntarios de Mesas de Votación) y Fiscales de Mesa para crear, a mano, los duplicados de informática y certificaciones, en base a los ORIGINALES de las Actas de Escrutinio de Votos (Acta#4) sea reemplazado por una única copia digital, inmutable y accesible de inmediato. Esto es una "Certificación Blockchain" (tecnología inventada en 1991). Es elemental que toda democracia pueda garantizar los resultados de las votaciones. Esto ya no es posible con tecnología de 1801 estando en el 2020. Debemos Modernizar y Actualizar el sistema electoral, especialmente el Escrutinio del Voto y la tecnología que lo garantiza, y esto es DEBER autónomo y administrativo del Tribunal Supremo Electoral (TSE). No le compete al Congreso ni a ninguna otra instancia del Estado. No vamos a permitir que incumplan más. Con el corazón de la democracia, no se juega.

El 16 de junio 2019 los guatemaltecos fueron convocados a las Elecciones Generales por el TSE para elegir un nuevo gobierno, cómo ha ocurrido desde 1985. Por primera vez desde entonces, la página de resultados del TSE del Sistema de Transmisión de Resultados Preliminares SITREP mostró cambios constantes, alarmantes e inexplicables a lo largo de 5 días hasta que fue congelada debido a una enorme presión ciudadana. El TSE ahora enfrenta un proceso de antejuicio sin precedente, acusados de incumplimiento de deberes, por la Fiscalía de Delitos Electorales del Ministerio Público. Es clave resaltar que este es el único caso penal abierto contra el TSE en este momento, haciendo urgente corregir la causa irresuelta del problema para evidenciar, mediante acciones y no palabras, a la ciudadanía y al Sistema Judicial que no se actúo con mala fe ni dolo cuando los Magistrados del TSE incumplieron en sus responsabilidades con el Departamento de Informática.

El 12 de Julio 2019 se publicó #Fiscal_Digital junto con su primer código en GitHub (bajo licencia MIT). El mundo entero ahora puede contribuir a una auditoría electoral, en tiempo-real, por medio de esta tecnología de Blockchain y CrowdsourcedOCR, compitiendo entre sí vía Gamification. #Fiscal_Digital es tecnología de código abierto, cívica y voluntaria, nacida con el apoyo de la Fundación Herencia Cultural Guatemalteca (FundacionHCG.org) y otros 27 patrocinadores locales e internacionales para auditar el escrutinio de las votaciones. Con un equipo de docenas de desarrolladores guatemaltecos, y hasta unos pocos extranjeros, hemos involucrado a más de 1,500 personas, principalmente jóvenes, que para enero 2020 produjeron más de 145,000 digitaciones en base a los duplicados entregados el 21 de junio del 2019, logrando validar más de 18,000 actas de las 126,000 DUPLICADAS que finalmente entregó el Departamento de Informática del TSE. 

Es importante resaltar que nuestras Solicitudes de Acceso a Información Pública, amparadas por la Constitución y la Ley, planteadas en agosto 2019, y nuevamente en noviembre 2019, donde solicitamos los otros 134,000 documentos ORIGINALES y no solo los duplicados producidos por el Departamento de Informática, aún no han sido atendidas adecuadamente por el TSE. Nos hace falta acceso a más de 134,000 documentos originales, equivalente al 51% de la documentación de escrutinio del voto nacional, asunto que imposibilita completar nuestro trabajo de auditoría ciudadana. 

Pero nuestro esfuerzo continúa y el 31 de enero 2020 fuimos invitados panelistas en el Capitolio de Estados Unidos en Washington DC en el evento organizado por el Government Blockchain Association (GBA) llamado El Futuro del Dinero, la Gobernanza y la Ley (FoMGL) auspiciado por el Comité de Trabajo de Blockchain del Congreso de EUA, entre otros patrocinadores, asunto que nos abre la posibilidad de llevar esta tecnología guatemalteca, creada por ex-voluntarios de las Juntas Receptoras de Votos-JRVs (mesas de votación), al mundo entero. Allí mismo recibimos el primer premio anual por Valentía.  Este reconocimiento ha generando interés en las recomendaciones de #Fiscal_Digital para autoridades electorales en países como: EUA, México, Panamá, entre otros. ¿Vamos a dejar que otro país implemente, antes que Guatemala, una innovación democrática, inspirada en las JRVs e inventada en Guatemala, antes que Guatemala?

Identificamos TRES maneras concretas en que el Sistema Electoral, específicamente el Escrutinio de los Votos, podría modernizarse y Actualizarse con nuevas tecnologías digitales. Dado que la Comisión de Actualización y Modernización Electoral (CAME) del TSE debe tratar de MODERNIZACIÓN y ACTUALIZACIÓN, hemos exhortado a priorizar la tecnología en el trabajo de esta comisión. Estas TRES maneras son

1. Certificaciones Blockchain
2. Rediseño OCR de las Actas
3. Redefinición del SITREP (Departamento de Informática y sus derivados) en base a estas Certificaciones Blockchain y el Rediseño OCR.

Es fundamental recalcar que estas 3 propuestas no requieren de aprobación del Congreso de la República sino competen exclusivamente al trabajo administrativo, AUTÓNOMO, del TSE. Por lo tanto, antes de entregar su mandato como magistrados del TSE en pocas semanas, podrían ser aprobadas hoy mismo mediante Acuerdo de Magistrados del año 2020. El Acuerdo de Magistrados 351-2019, donde se garantiza la entrega de JPGs con firma electrónica HASH (Artículo 3, Inciso A) demuestra que cuando la integridad digital de los datos del escrutinio nacional está en juego, y la ciudadanía lo exije, los Magistrados del TSE puede, debe y actúa ESE MISMO DÍA. El 6 de febrero del 2020 fue entregado un borrador del Acuerdo de Magistrados necesario al Presidente del TSE, osea, no hay excusa y se puede hacer hoy. Calculamos que los ahorros alcanzarán las decenas de millones, pero más importante, por mucho, harán al Sistema Electoral Guatemalteco, específicamente el Escrutinio de los Votos, uno de los más seguros, rápidos y confiables del planeta, recuperando la confianza de los Guatemaltecos que el próximo proceso no tendrá los SEVEROS problemas de comunicación de resultados preliminares que han conducido al Ministerio Público a presentar el primero y único proceso de antejuicio en contra del tribunal.

We count the votes together!

Fundamentally the #Fiscal_Digital proposal targets carbon paper (technology invented in 1801), currently utilized to create, by hand, the duplicates, triplicates and certificates that the volunteers at the JRVs (voting table volunteers) and political party witnesses get at voting tables to "guarantee" that results can't be tampered with. This expensive and ineffective technology can be replaced with a single digital copy which is immutable and immediately publicly accesbile. This is a "Blockchain Certification" (technology invented in 1991) y recognized all over the world as the most secure data base technology for digital content. It is fundamental that every democracy guarantee it's voting results. We must Modernize and Update election Technology and this is the autonomous and administrative DUTIES of the Guatemalan Election Authority (TSE). They cannot be allowed to derelict their duties any longer. The heart of democracy is not something to play with.

On June 16th 2019, Guatemalans were summoned to the General Elections by the TSE to elect a new government, as has occured since 1985. For the first time since then, the web page with preliminary results published by the election authorities known as the SITREP, operated by the TSE Information Technology Department, deomnstrated alarming and inexplicable changes throughout 5 days until it was frozen due to overwhelming citizen pressure. The TSE now faces an unprecedented impeachment process, accused of Dereliction of Duties, by the Election Crimes office of the Guatemalan General Prosecutor's office. 

On June 12th, 2019, #Fiscal_Digital published it's first open source code (under MIT license) on GitHub. The whole world can now contribute to an election audit, in real.time, via this Blockchain and CrowdsourcedOCR technology, competing with one another via Gamification. #Fiscal_Digital is open source technology born out of a civilian volunteer effort with the support of the Guatemalan Cultural Heritage Foundation (FundacoinHCG.org) and 27 other local and international sponsors to audit the vote count. With a team of dozens of software developers, mainly Guatemalans plus a few foreigners, we've involved over 1,5000 people, mainly young people, that by January 2020 produced over 145,000 digitizations from the duplicates that the IT department of the TSE delivered on June 21st, 2019. Over 18,000 election documents have been validated via our consensus model out of the 126,000 DUPLICATES that were finally handed over by election authorities.

It's important to note that our Requests to Access Public Information (equivalent to FOIA), which are enshrined in the Constitution and the Law, that were submitted in August 2019, then again on November 2019, where we requested the other 134,000 ORIGINAL election documents, no just de duplicates produced by the IT department of the TSE, have not been adequately addressed by the TSE. We lack access to over 134,000 original election documents, equivalente to over 51% of the election documentation. This fact means that it's impossible to complete our election audit, despite our best efforts.

But our effort continutes and on January 31st, 2020 we were invited speak at a panel on election technology at the USA Capitol in Washington DC at the event organized by the Government Blockchain Associatoin (GBA) called "The Future of Money, Governance and the Law (FoMGL)" sponsored by the Congressional Blockchain Caucus, among others, of this neighboring country. At the event, #Fiscal_Digital received the first Annual Achievement Award for Courage, a fact that opens up the possibility to take this Guatemalan technology, created by former voting table volunteers (JRVs) to the whole world. This has generated interested in countries like: USA, Mexico, Panama, among others. Will another country be the one to implement, before Guatemala, a democratic innovation, inspired by the Guatemalan JRVs and invented in Guatemala, before Guatemala adopts this technology?

We've identified THREE concrete ways in which the Election System can be modernized and updated to include new digital technologies, and given that the Electoral Commission for Modernizatión and Updating (CAME) of the TSE must deal with MODERNIZATION and UPDATING, we've exhorted them to prioritize technology utilized in the election system. These THREE ways are:

1. Blockhain Certifications
2. OCR re-design of vote count and election documents
3. Redefinition of the SITREP (IT Department and surrogates) to focus exclusively on correct implementation of Blockchain Certifications and OCR re-design

It is key to emphasize that these three recommendations do not require approval by the Republic's Congress but rather fall under the exclusive, administrative and AUTONOMOUS work of the TSE. Therefore, before the current Magistrates hand over their mandate (in a few weeks time in 2020), they could be approved via a Magistrate's Accord. A draft Accord has already been delivered to the President of the TSE, said differently, there are no excuses and it could be done today. We estimate that savings will be in the tens of millions, but more importantly by dar, the Guatemalan vote count will become one of the most secure, fast and trust-worthy on the planet, recovering the trust that Guatemalans lost in their voting system in 2019. The next voting process won't have the SEVERE communication problems that have driven the Guatemalan General Prosecutor's office to present a historical and unprecedented impeachment process against the election authorities.
