Stop the Ontario Court Of Appeal from using Intoxication as an Excuse for Sexual Assault
Why this petition matters
A law that bans an accused persons from using intoxication as a defence in the case of sexual assault is in the appeal stage, claimed to be "unconstitutional". Intoxication is close to being an excuse for sexual assault according to the Ontario Court of Appeal.
Essentially, if this decision goes through, intoxication will be a defence for a perpetrator of sexual assault, even when they chose to get drunk themselves.
This decision is dangerous. Sexual assault offenders need to be brought to justice and that means that perpetrators must be held accountable for their actions and sentenced accordingly. This ruling is a disservice to everyone in Ontario.
If the Court of Appeal's decision gets overturned, that means that people who have committed sexual assault while drunk will be more likely to be imprisoned and kept away from their victims. This decision must be overturned to ensure victims get justice.
