Wir sind Teil der globalen Community von Fanfiction-Autor*innen und -Leser*innen. Durch unser ehrenamtliches Engagement tragen wir zur kulturellen Vielfalt, künstlerischen Bildung und zum gesellschaftlichen Zusammenhalt bei. Wir wenden uns an die Mitglieder des deutschen Bundestags mit der Bitte, unsere Belange in der Urheberrechtsreform nicht unter den Tisch fallen zu lassen.

Die Urheberrechtsreform hat das Potential, Rechtssicherheit für Fanfiction und andere Fanwerke im deutschen Urheberrecht zu schaffen. Durch die EU-Urheberrechtsrichtlinie wird die Ausnahme für Karikatur, Parodie und Pastiche erstmals verpflichtend für alle Mitgliedstaaten. Sie ersetzt in Deutschland die freie Benutzung, auf die sich Kunstformen wie Fanfiction von jeher stützen konnten.

Wir begrüßen, dass die Begründung des Gesetzesentwurfs zur Anpassung des Urheberrechts an die Erfordernisse des digitalen Binnenmarkts klarstellt, dass Fanfiction und Fanwerke unter der neuen Ausnahme für Pastiche auch in Zukunft erlaubt sein sollen. Allerdings sind wir bestürzt, dass der Gesetzesentwurf eine Einschränkung der Urheberrechtsausnahme vorsieht, die mit dem EU-Recht unvereinbar ist und große Rechtsunsicherheit für die Urheber*innen und Fans von Fanfiction und Fanwerken schafft. Demnach sollen Karikatur, Parodie und Pastiche nur dann erlaubt sein, "sofern die Nutzung in ihrem Umfang durch den besonderen Zweck gerechtfertigt ist". Für die Fanfiction-Community ist diese Bedingung gänzlich unverständlich. Sie sorgt für große Rechtsunsicherheit, denn wie alle Kunstformen ist Fanfiction nicht utilitaristisch - sie verfolgt keinen anderen Zweck als den Ausdruck unserer Persönlichkeit und den Wunsch, unsere Kunst mit der Welt zu teilen. Die Voraussetzung, dass urheberrechtlich erlaubte Nutzungen an einen Zweck gebunden sein müssen, entstammt dem wissenschaftlichen Zitatrecht und ist für künstlerische Ausdrucksformen völlig fehl am Platz. Die meisten Autor*innen von Fanfiction sind außerdem keine Jurist*innen und wir können nicht einschätzen, was der Gesetzesentwurf von uns verlangt, um unsere Kunst wie bisher ohne Angst vor juristischen Konsequenzen im Internet veröffentlichen zu dürfen.

Außerdem beobachten wir Forderungen von einigen Verwertungsgesellschaften und Verbänden mit Sorge, die eine allgemeine Vergütungspflicht für Pastiche fordern. Der Gesetzesentwurf sieht bereits vor, dass kommerzielle Plattformen, die unter Artikel 17 der Richtlinie fallen, eine Vergütung für diese und andere Urheberrechtsausnahmen zahlen sollen. Auf keinen Fall darf es eine Vergütungspflicht für diese Urheberrechtsausnahme außerhalb des Urheberrechts-Diensteanbieter-Gesetzes geben! Die freie Benutzung, auf die sich Fanfiction in der Vergangenheit stützen konnte, war nie vergütungspflichtig. Wenn Fanfiction künftig vergütungspflichtig würde, wäre das ein Geschenk an die großen, kommerziellen Plattformen. Urheber*innen von Fanfiction müssten plötzlich für Uploads auf beliebte nichtkommerziellen Fanfiction-Portale wie Archive of our Own bezahlen, während der Upload derselben Werke in Facebookgruppen oder auf anderen kommerziellen Plattformen für sie kostenfrei wäre, weil in diesen Fällen die Plattformen die Vergütung zahlen. Die Fanfiction-Szene würde also gegen ihren Willen in die Hände der großen Technologiekonzerne getrieben, unabhängige Communityportale wären in ihrer Existenz bedroht.

Wir fordern:

  • Streichung der Bedingung für die Legalisierung von Karikatur, Parodie und Pastiche, "sofern die Nutzung in ihrem Umfang durch den besonderen Zweck gerechtfertigt ist"!
  • Keine Vergütungspflicht für Karikatur, Parodie und Pastiche außerhalb des Geltungsbereichs des Urheberrechts-Diensteanbieter-Gesetzes!

Legal certainty for fan fiction in German copyright reform.

We are part of the global community of fan fiction authors and readers. Through our volunteer work, we contribute to cultural diversity, artistic education and social cohesion. We turn to the members of the German Bundestag with the request not to let our concerns fall by the wayside in the copyright reform.

The copyright reform has the potential to create legal certainty for fan fiction and fan art in German copyright law. The EU Copyright Directive makes the exception for caricature, parody and pastiche obligatory for all member states for the first time. In Germany, it replaces the free use provision on which art forms such as fan fiction have always been able to rely.

We welcome the fact that the explanatory memorandum of the draft law on the adaptation of copyright to the requirements of the digital single market clarifies that fan fiction and fan art will continue to be permitted under the new exception for pastiche. However, we are dismayed that the draft law provides for a condition to the applicability of the copyright exception that is incompatible with EU law and creates great legal uncertainty for authors and fans of fan fiction and fan art. According to the bill, caricature, parody and pastiche will only be allowed "if the extent of the use is justified by the specific purpose". For the fan fiction community, this condition is completely incomprehensible. It creates great legal uncertainty because, like all art forms, fan fiction is not utilitarian - it has no purpose other than the expression of our personality and the desire to share our art with the world. The requirement that copyrightable uses must be tied to a purpose stems from the academic quotation exception and is completely out of place in the context of artistic expression. Moreover, most authors of fan fiction are not lawyers and we cannot assess what the draft law expects of us in order to be able to publish our art on the internet as before without fear of legal consequences.

We are also concerned about demands from some collecting societies and associations that call for a general remuneration obligation for pastiche. The draft law already provides that commercial platforms covered by Article 17 of the Directive should pay remuneration for this and other copyright exceptions. Under no circumstances should there be a remuneration obligation for this copyright exception outside the Copyright Service Providers Act! The free use provision on which fan fiction could rely in the past was never subject to remuneration. If fan fiction were to be remunerated in the future, it would be a gift to the big commercial platforms. Creators of fan fiction would suddenly have to pay for uploads to popular non-commercial fan fiction portals like Archive of our Own, while uploading the same works to Facebook groups or other commercial platforms would be free of charge for them, because in these cases the platforms pay the remuneration. The fan fiction community would thus be driven against its will into the hands of the big technology corporations, and independent community portals would be threatened in their existence.

We demand:

  • Deletion of the condition limiting caricature, parody and pastiche to cases where "the use is justified in its extent by the specific purpose"!
  • No remuneration obligation for caricature, parody and pastiche outside the scope of the Copyright Service Providers Act!
