Why this petition matters

Started by Americans Against Abusive Probate Guardianship

1.  Based on the government statistics that nearly half of all COVID-19 deaths in the United States occur in nursing homes, we had reason to believe when this petition was created that everyone incarcerated in senior warehousing across the United States was at risk of dying from COVID-19 infections. Countless thousands of wards/conservatees who have committed no crimes are highly likely to get sick or die in captivity;

 2. The U.S. Constitution and international human rights treaties that are part of America’s federal law uniformly support the concept that the punishment should fit the crime. When highly vulnerable allegedly incapacitated wards who have committed the crime of growing old in America risk near certain death as a result of a judge’s decision to strip them of their rights and place them into dangerous environment – our nation is flirting with genocide;

3.  Administrative probate judges are not empowered to choose one life versus another.  In the context of a pandemic, their rulings should be limited to administrative matters but not decisions that may include exposure to a deadly virus.  When the risk of death is too high, wards who have committed no crime should be released under appropriate terms and safeguards;

4.  Despite desperate cries from the families of conscripted guardianship and conservatorship wards, judges are refusing to move wards out of harm’s way into alternate domicile that may be safer and in particular releasing them to the homes of family members where they would be welcome;

5.  The UN Human Rights Committee encouraged the Trump Administration to meet with Opt IN USA and other civil society groups about such dilemmas before average Americans even knew of a COVID-19 pandemic.  Opt IN USA’s basic complaint is that America’s legal system is regularly weaponized against minorities and the most vulnerable among us and anybody else it wants to take down.  On January 18, 2020, a coalition of 20 organizations joined in requesting the Trump Administration/Opt IN USA meeting, so far to no avail;

6.  Louisiana United International, Inc. (LUI) is among those 20 organizations.  It is also leading the fight against the COVID-19 Death Chambers that Louisiana's detention centers, jails, and prisons have become.  The Trump Administration should meet immediately with LUI as part of an Opt IN USA delegation.  The lives of many Black people incarcerated in Louisiana are at stake.  Time is of essence;   

7.  Americans against abusive probate guardianship (www.aaapg.net), a national 501©(3) dedicated to reducing or eliminating abusive guardianships in the United States through advocacy, education and legislation joins with other civil society groups to demand that the protections of the United States Constitution and the treaties of the United Nations be enforced to protect the wholesale slaughter of innocent victims of the probate court guardianship machine during the ongoing COVID-19 pandemic of 2020 and beyond;

8.  AAAPG fervently requests the honor of participating in a high level meeting with top administration officials even including President Donald J Trump to begin the process of protecting the most vulnerable in our society from exposure to the killing fields that exist in senior warehousing in the United States during this pandemic which are populated in large part by decisions made in probate guardianship administrative equity courts.
