Respetable Sr. Presidente:

Le solicitamos por favor que nos ayude a salvar nuestra vivienda; debido a una demanda de financieras y a que nuestro abogado nos dejó en indefensión. Necesitamos ayuda. Defender la vivienda es un derecho humano, es terrible que la avaricia de algunas  financieras y profesionales legales hagan perder a los ciudadanos el fruto de su trabajo y el lugar de residencia. Necesitamos menos corrupción y más protección de las autoridades. Apoya esta petición para que salvemos nuestro hogar, y se haga una ley que proteja el patrimonio de los mexicanos. 

Me uno a los deseos del pueblo de México para que su presidencia sea un verdadero ejemplo de servicio y justicia, y que todos podamos recuperar la confianza en las autoridades. Solicito su ayuda porque me encuentro en una situación desesperada, después de 6 años de juicio inmobiliario estoy a punto de perder mi propiedad; un departamento en la Ciudad de México en el cual vive y trabaja en su obra mi hija desde hace 13 años. Ella se dedica a la educación y la cultura -publica libros, pinta, etc.-, por lo que es conocida por sus nombres artísticos: Iris México, Iris Atma, Ki Victorieux. Tengo la mejor disposición de llegar a un acuerdo para pagar la deuda y conservar mi propiedad. Lamentablemente, carezco de la información en leyes o finanzas y por lo tanto mi juicio no ha tenido una buena defensa a pesar que contraté dos abogados. Espero considere apoyarme, estoy y me siento en una situación muy vulnerable; necesito la ayuda de la justicia, ojalá que al denunciar esta situación me brinde una esperanza.

Soy una mujer de 77 años, nacida el 2 de septiembre de 1942 en Chiapas, vivo en la ciudad de Tapachula, Chiapas, frontera con Guatemala. Usted conoce muy bien la grave crisis económica y social que se ha agudizado en las fronteras. He trabajado desde los quince años de edad, y es con muchos esfuerzos que he logrado sostener a mi familia. Me dedico al comercio y soy una persona honrada, y espero mi plegaria llegue a alguien de buen corazón, con posibilidades de ayudarme.

Adquirí el inmueble en la Colonia Escandón, Delegación Miguel Hidalgo, el 13 de diciembre del 2006 con la Hipotecaria Su Casita. Di $300 mil de enganche, y más de $157 mil por gastos de trámites y escrituración. Quedé pagando mensualidades de alrededor de $12 mil pesos, durante 5 años. Su Casita quebró en el 2011, se fue de la ciudad de Tapachula sin aviso alguno. Me llamó ING Hipotecaria y les pagué dos mensualidades, pero no me dieron recibo, por lo que suspendí el pago de mensualidades. La deuda la adquirió HSBC, y después Santander Vivienda, quienes me demandaron en el 2013, por lo que contraté los servicios profesionales del Lic. Munir Tanous desde el 2014, cubriendo sus honorarios mensuales de $3,200 durante más de 5 años, hasta este 2019. El 11 de julio de 2016 gracias a la intervención del abogado Manzur ofrecí $300 mil a la Comisión Nacional Bancaria y de Valores a fin de manifestar mi interés de llegar a un acuerdo. Este dinero lo tuvieron dos años y me fue devuelto en el 2018, y me imaginé que era una señal de que mi caso iba avanzando favorablemente. Sin embargo este 2019 el Dr. José Luis Ramos y Fusther de Flota, quien compró la deuda, me notifica que el juez podría firmarle las escrituras de mi propiedad en rebeldía. Esto me sorprendió mucho, porque yo pensaba estar protegida legalmente por mi abogado Munir Tanous. Ante esta situación, solicitamos ver el expediente, y nos hemos dado cuenta de muchas irregularidades en el proceso: Tanous no nos defendió, ni nos notificó del estado real de los procesos del juicio y su avance en nuestra contra. Me dejó en estado de indefensión. Yo desconocía que estaba en rebeldía ante el juez. Debido a nuestra confianza en el abogado e ignorancia en los procesos legales y financieros, estamos en una situación muy angustiante. Estoy segura que esta situación se repite en muchas personas que luchan día a día por hacerse de un patrimonio. Espero que la convicción que usted manifiesta en los valores de justicia, en la defensa de derechos humanos, en la denuncia y visibilización de abusos, corrupción e injusticias, le mueva a apoyarnos a conservar nuestra vivienda.

Tengo fe en que sabrá tener misericordia. Como dijo Miguel de Unamuno: La última y definitiva justicia es el perdón. Como todos sabemos, esta situación de que he vivido en carne propia seguramente puede pasarle a muchas otras personas. Es lamentable que existan situaciones que dejen a los demandados en un estado de indefensión, usted tiene la oportunidad de crear una nueva ley que gestione una protección al patrimonio de los mexicanos. Por favor, ayúdenos, Dios le bendecirá.

Respectable Mr. President:

We ask you to please help us save our home; due to a financial lawsuit and because our lawyer left us defenseless. We need help. Defending housing is a human right, it is terrible that the greed of some financial and legal professionals make citizens lose the fruit of their work and place of residence. We need less corruption and more protection from the authorities. Support this petition to save our home, and to make a law that protects the patrimony of Mexicans.

I join the wishes of the people of Mexico so that your presidency may be a true example of service and justice, and that we can all regain confidence in the authorities. I request your help because I am in a desperate situation, after 6 years of being involved in a lawsuit, I am about to lose my property; a department in Mexico City where my daughter has lived and worked for 13 years. Su Casita went bankrupt in 2011, he left the city of Tapachula without any notice. Then ING, another financial company, asked for the payments, and I paid two monthly payments, but they did not give me a receipt, so I suspended  payments. The debt was acquired by HSBC, and later by Santander Vivienda, another financial companies, who sued me in 2013, for which I hired the professional services of Lic. Munir Tanous since 2014, covering his monthly fee of $ 166.57 dollars for more than 5 years, until 2019. On July 11, 2016, thanks to the intervention of attorney Manzur, I offered $ 15,612 dollars to the National Banking and Securities Commission in order to express my interest in reaching an agreement. This money they had for two years and it was returned to me in 2018, and I figured it was a sign that my case was progressing favorably. However this 2019 Dr. José Luis Ramos and Fusther de Flota, who bought the debt, notifies me that the judge could sign the deeds of my property in default. This surprised me a lot, because I thought I was legally protected by my lawyer Munir Tanous. Faced with this situation, we requested to see the file, and we have noticed many irregularities in the process: Tanous did not defend us, nor did he notify us of the real state of the trial processes and his progress against us. It left me in a state of helplessness. I did not know I was in revolt in the eyes of the jury. Due to our trust in the lawyer and our ignorance in the legal and financial processes, we are in a very distressing situation. I am sure that this situation is common to many people who struggle every day to make a patrimony. I hope that the conviction that you manifest in the values ​​of justice, in the defense of human rights, in the denunciation and visibility of abuses, corruption and injustice, will move you to support us to conserve our home.

I have faith that you will know how to have mercy. As Miguel de Unamuno said: The ultimate and final justice is forgiveness. As we all know, this situation that I have experienced firsthand can surely happen to many other people. It is regrettable that there are situations that leave the defendants in a state of defenselessness, you have the opportunity to create a new law that manages a protection to the patrimony of Mexicans.
