TELL CONGRESS TO ENACT THE DOJ RECOMMENDED REFORMS FOR SECTION 230 of the COMUNICATIONS DECENCY ACT

In June 2020 the U.S. Department of Justice, along with teachers, parents, and tech industry experts, reviewed Section 230 of the Communications Decency Act and found that reforms to address Child Sexual Abuse Material (CSAM) and human trafficking were greatly needed.

“Criminals and other wrongdoers are increasingly turning to online platforms to engage in a host of unlawful activities, including child sexual exploitation, selling illicit drugs, cyberstalking, human trafficking, and terrorism. At the same time [interpretation of Section 230], combined with technological developments, has reduced the incentives of online platforms to address illicit activity on their services and, at the same time, left them free to moderate lawful content without transparency or accountability.

Dear Sir/Madam:

I am writing to you to request that you incorporate the U.S. Department of Justice’s Digital Safety Task Force recommendations into any section 230 reform law of the Communications Decency Act, and reform this legislation to address Child Sexual Abuse Material (CSAM) and human trafficking on ISPs and other social media platforms.

Child Sexual Abuse Materials online has increased by an astonishing 4,200% over the last five years. The CyberTipline currently receives over 1 MILLION reports each month, but with increasing difficulty to investigate the rising number of reports, many criminals are getting away with heinous crimes online.

In response to the rise of CSAM and human trafficking originating online, we need to enact reforms to Section 230 that incentivize ISPs to use technology to curtail CSAM on their platforms, without curtailing the importance of freedom of speech. I feel the U.S. Department of Justice’s proposed reforms in the Ramseyer Draft meet these requirements.
