Why this petition matters

HIPAA was passed in 1996 to protect sensitive health information and to keep companies accountable. It protects our fundamental right to privacy. Yet, new technology undermines this right. Wearable technology, like Fitbit and Apple Watch, collects health information to show the wearer. The data they collect qualifies as personal health information (PHI), the same type of information that HIPAA protects. Yet, these companies don't have to comply with HIPAA since they aren't a "covered entity." Notable wearable technology manufacturers claim that their products are HIPAA compliant. But if this is already the case, why not make their point legally enforceable.

The data wearables collect could benefit many people, and the technology's use and applications will only progress. But if this data is not secured and protected, we risk losing our rights. Almost everyone has some wearable technology today; when this is the case, the law that protects our data should be just as universal. Sign this petition to include wearable technology manufacturers as a "covered entity" and ensure the continued protection of our data.
