The state of Georgia currently does not have any legislation protecting the ability of electric vehicle owners from being prevented from charging by non-electric vehicles being parked in charging station parking spots.  As such, I am proposing the following amendment to the Georgia Code:

Electric vehicle charging station parking restrictions.

(a)   For the purposes of this section, “electric vehicle charging station” means a public or private parking space that is served by charging equipment that has as its primary purpose the transfer of electric energy to a battery or other energy storage device in an electric vehicle.

(b)   An electric vehicle charging station must be indicated by vertical signage identifying the station as an electric vehicle charging station and indicating that it is only for electric vehicle charging pursuant to O.C.G.A. §40-6-200.

(c)   No person shall stop, stand or park a motor vehicle within any parking space specially designated for parking and fueling motor vehicles fueled exclusively by electricity unless the motor vehicle is powered by electricity, engaged in the refueling process and has been issued an alternative fuel vehicle special plate or decal pursuant to O.C.G.A §40-2-86.1.

(d)   Any person or local authority owning or operating any public or private off-street parking facility may, after notifying the police or sheriff’s department, remove or cause to be removed to the nearest garage or other place of safety any non-electric vehicle parked within an electric vehicle charging station space designated for use by electric vehicles.

(e)   Violations of this section are subject to fines pursuant to O.C.G.A §40-6-252.

In addition, making recommendations to amend Georgia Code O.C.G.A §40-2-86.1, to add the following new subsection to allow for owners of alternative fueled vehicles (AFV) who do not wish to have the special license plate for AFV to comply with being issued a decal.

O.C.G.A §40-2-86.1 (7) (D) In lieu of a special license plate being issued for alternative fueled vehicles pursuant to paragraph (7) of subsection (C) of Code Section 40-2-86.1, the department shall issue parking decals for alternative fueled vehicles.  Decals shall be in such form as the department prescribes but shall be of sufficient size and sufficiently distinctively marked to be easily visible when placed on or affixed to the driver's side of the dashboard or hung from the rearview mirror of the parked vehicle. Permits shall be made of a substrate as determined by the commissioner and shall be of sufficient quality to ensure that the coloring of the permit and the ink used thereon will resist fading for a period of at least four years. The words "alternative fueled vehicle" shall be imprinted on such special decals.  Permits shall be issued to individuals, and the name of the individual and an identification number shall appear on the permit.
