Dear Supporters,

Following the Home Office allegation that "I am not legally stateless and I am able to return to Malaysia through a voluntary returns scheme. The Home Office will negotiate with the Malaysian authorities on my behalf to assist my return" [Link]

- I have written to the Home Office and the Home Secretary, Rt. Hon Priti Patel [Link] and published an Open Letter on my petition [Link], to ask the Home Office to disclose detail information of their allegation, and explain their reasoning, in writing.

- I have written to the Malaysian authorities again for detail information related to the Home Office allegation [Link]. Below is the 'Open Letter' to the Malaysian authorities.


OPEN LETTER TO THE MALAYSIAN AUTHORITIES

To the Malaysian authorities,

My DOB: provided in email to Malaysian authorities
Renunciation of Malaysian citizenship certificate no.: provided in email

Please clarify and confirm with response in English to 23 questions below with regards to the predicament of the British Overseas Citizen (BOC) who no longer a Malaysian citizen:

1) Am I a Malaysian citizen?
Yes or No

2) If Yes to question 1, please confirm in writing.

3) If No to question 1, please explain your reasoning.

4) Can I reinstate and/or re-acquire my Malaysian citizenship with immediate effect?
Yes or No

5) If Yes to question 4, please confirm in writing and stipulate the constitution and law.

6) If No to question 4, please explain your reasoning in accordance with the 1954 UN Convention relating to the Statues of Stateless persons and the 1961 UN Convention on the Reduction of Statelessness.

7) Can I return to Malaysia for the purposes of permanent residence with immediate effect?
Yes or No

8) If Yes to question 7, please provide written confirmation and guarantee in writing that I can return to Malaysia for the purposes of permanent residence with immediate effect.

9) If No to question 7, please explain your reasoning in accordance with the 1954 UN Convention relating to the Statues of Stateless persons and the 1961 UN Convention on the Reduction of Statelessness.

10) Is there a new negotiation/discussion with the UK authorities for the BOC to return to Malaysia for the purposes of permanent residence?
Yes or No

11) If Yes to question 10, when did the new negotiation/discussion start?
What happen to the previous negotiation? According to the UK then Minister of Immigration, Mark Harper MP, there was an ongoing discussion with the Malaysian authorities back in 2012 [[Paragraph 51 & 52, 2018 High Court Determination - Link]

12) If No to question 10, has the negotiation with the UK authorities concluded with a written agreement?
Yes or No

13) If Yes to question 12, please provide the evidence in writing, and a copy of the written agreement

14) If No to question 12, please explain your reasoning in writing, why the negotiation with the UK authorities has not concluded and there is no written agreement [Column 1679, 2014 Hansard - Link]; Page 1, 2018 Home Office's Freedom of Information response - Link]

15) What are the Malaysia's obligations to people like myself who was formerly a Malaysian citizen but now only have British Overseas Citizenship status and do not have a right of abode anywhere?

16) Under the section the "Requirements of Residence Pass application for BOCs", Jesmin stated that 'renounced Malaysian citizenship on/before 4th July 2002 (after 4th July 2002 will not be accepted)'.
Please confirm and clarify the stipulation of this requirement.

17) The 'Residence Pass application for BOCs are just a brief guidelines. For further details, please refer to the Immigration Attache.'
I am requesting the Immigration Attache and/or the Malaysian authorities to confirm and clarify the full details of the Residence Pass application for BOCs

18) Is being granted "Residence Pass" stipulates as being able to live in Malaysia as a permanent residence with immediate effect?
Yes or No

19) If Yes to question 18, please confirm in writing, and under which constitution/law/policy/guidelines/guidance

20) If No to question 18, please clarify the rights and entitlement of having a "Residence Pass"

21) Is the "Residence Pass" application for BOCs guarantee to be approved?
Yes or No

22) If Yes to question 21, please confirm in writing.

23) If No to question 21, please explain your reasoning why it is not guaranteed.

There are total of 23 questions in this email and all questions are mandatory for answers.

I look forward to your answers with relevant documentation, no later than 21 August 2020.

If you do not response to this email, your silence is acquiescence that the Malaysian authorities confirm that:
a) I am no longer a Malaysian citizen
b) I cannot reinstate and/or re-acquire the Malaysian citizenship with immediate effect
c) I cannot return to Malaysia for the purposes of permanent residence with immediate effect
d) I am not eligible to apply for the "Residence Pass" as the renunciation of my Malaysian citizenship was after 4th July 2002
e) If I apply for the "Residence Pass", the application will guarantee to be rejected as I do not meet the requirement.
