Why this petition matters

This is a petition to the next United States Attorney General who serves under Joe Biden's presidency. As of the time of this writing, there are rumors that former Supreme Court nominee Merrick Garland is the most likely candidate to be nominated by Biden to be his attorney general, but this petition will be submitted to whoever the new Attorney General ends up being. It is a petition to prosecute current US President Donald Trump and current US Attorney General William Barr for conspiracy against rights under 18 USC § 241 once they are no longer in power.

On June 1, 2020, Trump and Barr exercised a blatantly unconstitutional show of force when they used federal police officers to forcibly eject peaceful protesters from Lafayette Square in the District of Columbia, just so President Trump could have a photo op without fear of interruption from the protesters. The protesters were not violating curfew, nor was there any evidence that the protests had turned violent. There was nothing happening in that location that day to even remotely justify such an act. Because Trump and Barr worked together to orchestrate this appalling attack, that is sufficient to satisfy the "two or more persons" requirement of § 241.

When prosecuting a former President for acts taken in office, it is imperative that we take great caution to avoid setting the dangerous precedent of former Presidents becoming targets of the State due to their controversial, but otherwise perfectly legal, actions in the White House. However, that is precisely why Trump's and Barr's actions on June 1, 2020 are an ideal crime to charge them with: Because this transcends mere partisan disputes. This is not a partisan issue. This is hardly even a political issue. To the contrary, the forceful ejecting of peaceful protesters over the pettiest of motives goes to the very foundation of our country's core values. This is more than just an infringement on any one person's constitutional rights. Trump's and Barr's actions on 06/01/2020 were a calculated and malicious attack on the very concept of democracy itself. As famous District of Columbia attorney Devin Stone (better known by his Youtube name: LegalEagle) famously said: "It was the stuff of tin pot dictators in banana republics."

For these reasons, prosecuting Trump and Barr for this crime is not likely to lead to the precedent of former presidents becoming targets of the State for their political beliefs, no matter how legal those beliefs are. To the contrary, a failure to prosecute this crime risks setting a far more deadly precedent: That the President is de facto above the law; that the President has limitless authority to violate the law, and even violate the most sacred of constitutional rights (such as the right to free speech) for the pettiest of reasons, with no regard to the consequences, since there will not be any consequences in the first place.

That precedent must be avoided at absolutely all costs. Even if a minority of future presidents might be ever so slightly chilled that what they do in office might land them a spell in jail after they leave office, that is a small price to pay for upholding the Rule of Law, as well as our country's most sacred democratic values.

All American citizens who sign below hereby beseech whoever President-Elect Joe Biden chooses to be his Attorney General next January to prosecute then-former President of the United States Donald Trump and then-former Attorney General William Barr for conspiracy against rights in the aforementioned case. The Rule of Law is more important than partisan disputes.
