The Right to Fight
Why this petition matters
The Right to Fight will allow the victim’s family to sue for medical malpractice, in order to hold the medical institutions responsible for their errors by repealing the Tort Reform, Uniform Anatomical Gift (UAGA), and the Texas Advance Directives Act.
The hospital and medical staff needs to start being held accountable for their malpractice and negligence!
“Perhaps the most devastating is Texas “tort reform.” Texas politicians have made pursuing medical malpractice cases extremely challenging for patients. Tort reform greatly limits what a plaintiff can recover even in horrific circumstances. It is my opinion that Texas tort reform, as well as the venue where the claim would have to be brought, would greatly impact any potential claim. With these laws, it is simply prohibitive for attorneys to represent injured patients except in very special circumstances.” -Marc Stewart Law
Did you know that in Texas and other states, you DO NOT have rights over your loved one if they’re being declared “brain dead” when they’re in coma after surgery, even if they’re showing Signs of Life? Especially if they were/are an organ donor! Even if you’ve removed your registration, Life Gift will pull your old document up anyway. The corruption needs to end and it starts with us Americans and everyone who lost their loved ones due to medical malpractice/negligence.
The Right to Fight will also give ALL medical rights to the next of kin, regardless if their loved ones are being considered “brain dead.” There are many “brain dead” survivors who woke up during their hospital stays or on the operation table for harvesting organs!!!
