我們認為政府以一年期時間押後2020年立法會選舉是破壞憲制、不符比例的方案。《基本法》第69條清楚表明立法會每屆任期為四年。若延選一年，以「緊急會議」或「臨時立法會」去取代經法定選舉產生的議會處理立會事務，則跨越原有職權。而上屆議員的民意授權本已結束，民眾亦無法透過選舉收回其授權，因此現屆議員任期亦不合理。

由於2020年9月6日這日期已早於多個月前定下，「舉辦一次立法會選舉投票須有長時間準備，不可能14日後話做就做，所以須押後一年」此道理實在說不通！立會選舉籌劃原本已足夠時間準備，押後兩星期並非突發事情，而是有足夠時間部署。加上《立法會條例》早已有處理社會突發狀況的機制及時間表。

若本港近日疫情持續，我們要求政府應按照《立法會條例》將是次立法會選舉投票押後14天，每14天檢討一次。按香港市民抗疫的良好紀錄，疫情將於短時間內穩定及好轉。防疫措施充足下，全球三十多個國家都已於疫情期間按時完成選舉。香港政府不能剝奪港人選舉權利，應按原有規例完成是次立會選舉。

The government's deferment of the 2020 Legislative Council election for one full year is an unproportionate  maneuver. Article 69 of the Basic Law clearly stated that each LegCo term shall be four years in length. If the election is postponed for a full year, "emergency meetings" or a "provisional legislature" are in danger of replacing democratic votes. These actions exceed original functions, powers, and norms. Since the 6th Legislative Council has already exhausted its mandate, delaying an election is effectively extending a term through fiat. This is an insult to Hong Kong’s voters as well as future Legislative Councilors, regardless of party. 

Given that the date (September 6th, 2020) was set months earlier, necessary preparations have already been fulfilled or are being fulfilled. The government’s excuse of “holding the election requires a long period of preparation and impossible to do in 14 days and must therefore be postponed for one year" is either a lie or an admission of its incapability to organize an election. With months of preparation, a two-week postponement should not be a sudden surprise. There should be enough time to take precautions. Moreover, the LegCo Ordinance already has mechanism in place to manage social and medical emergencies.

If the epidemic in Hong Kong continues to fester, the government should enact an extendable 2 week postponement, with a review every 14 days in accordance with the LegCo Ordinance. Hong Kong citizens have successfully fought epidemics (including 2 waves of Covid-19). We believe the situation will stabilize.  Good policy and a city-wide effort can help see ourselves through our frightening predicament. Strong and clear preventative measures have helped more than 30 countries administer their elections on time, there is no reason why Hong Kong can’t do the same. The LegCo election should be completed in accordance with the original regulations.
