I made this petition so hopefullySt Louis County Planning Commission will vote against re-zoning for Shadow Point Subdivision Devolopment. This issue affects nearby residents of Oakville and we need change now! Please sign and share with others!

Residents of Oakville against McBride Berra Land Company LLC 

Shadow Point Subdivision will create home damaging blasting, extra traffic and potential flooding of Forest Creek homes.  

Nearby Oakville residents could suffer from blasting similar to other projects in the past such as Rogers elementary school that required more blasting than was originally planned for. 

When a homeowner sustains damage to their home from blasting their options are limited.  The first option is to file an insurance claim.  The insurance company would pay the claim, minus the deductible, and then go after the blasting company for the costs. The other option is for the homeowner to sue the blasting company directly.  Either way blasting can be costly to the nearby homeowners. 

If someone is concerned about potential structural damage to the home, they should hire an independent structural engineer to inspect the property before the blasting starts, Otherwise, the blasting company could have a “ready argument” that any damage was there before the blasting started.  Again more money out of nearby homeowner pockets.  

Property damage from the blasting isn't the only concern. The dust kicked up by the explosions are a health risk for the elderly and those with respiratory problems. The blasts can also expose large boulders, which can roll uncontrollably downhill.  

The northeast quadrant of Telegraph Road and Fine Road have at times very high amounts of traffic.  Adding 53 more homes will only make the streets more busy and should require a continuous turn lane from Arrowhead Estates until Fine Road to make travel more safe for nearby residents.  

Flooding seems to get worse every year and the small creek Shadow Point Subdivision is planning on using to accommodate all drainage from 53 homes is connected to the Meramec River potentially causing flooding to the homeowners in Forest Creek Subdivision whose property lines back up to this creek.  

There are other reasons not mentioned in this petition but these are examples of reasons nearby residents should be concerned.  We know we can not stop the inevitable construction on the land but we need more procedures in place before we are ok with it.  

The undersigned petitioners therefore ask St Louis County Planning Commission Members to: 

1. Vote against changing the current zoning ordinance from NU (non-urban) to R-2. 

And

2. Vote against Planned Environment Unit(P.E.U.) for 53 Single family residences.
