We, residents of Denver, Colorado, ask City Council to Vote NO on the EAP for any one of the following reasons.

• We oppose the removal of language from the Plan that provided that “areas that are primarily single-unit should remain single-unit,” and support the amendment being offered by Council Members Sawyer and Herndon to add the language back into the Plan. Since city planners have acknowledged that the East Area can accommodate expected growth without zoning changes, the elimination of this provision is not necessary.

• Even if this provision is restored to the East Area Plan, we believe that a vote on the East Area Plan should be tabled until after City Council takes action to address a number of critical citywide concerns, including the allowance of ADUs on residential properties, residential infill, group housing, linkage fees, and infrastructure expansion and upgrades. Until such matters are addressed, it is impossible to assess the impact of the East Area Plan on the East Area and its residents, or to ensure that the burdens and benefits of the planning process are shared equitably throughout different neighborhoods.

• Blueprint Denver does not apply to areas that are under Chapter 59, possibly 95 Metropolitan Districts, and 998 Home Owner Associations. EAP cannot be considered equitable if many areas are exempt.

• Finally, if the proposed text amendments fail to pass, we will be bound by the EAP. There are no stop gaps in place to remove these provisions from the EAP should the legislation fail. This is inequitable.

We urge City Council to (1) adopt the Sawyer-Herndon Amendment to restore language to the East Area Plan providing that areas that are primarily single unit remain single unit; (2) table any vote on the East Area Plan until after such time that measures related to the allowance of ADUs on residential properties, residential infill, group housing, linkage fees, currently exempted of areas within Denver are brought under Blueprint Denver and the expansion and upgrading of infrastructure are enacted on a citywide basis; and (3) if the proposed text amendments fail, there are stop gaps in the EAP removing these provisions. If these three conditions are not met, we ask that you vote NO on the proposed EAP.
