Why this petition matters

Started by CRR Sastry

The Armed Forces Tribunals (AFT) were created by the Parliament to provide quick and inexpensive justice to members of the Armed Forces and the retired personnel of the Armed Forces.  While doing so,  the jurisdiction of all courts except that of Supreme Court have been ousted. Barely after five years of their constitution,  many benches of the AFTs have become dysfunctional as the vacancies in either the Judicial or Administrative members are not filled.

The circuit benches have been constituted for the benefit of applicants. However due to the large vacancies in benches,  these circuit benches are sitting once in four months.

The situation has come to a state where the defenders of the Nation are virtually left without Justice.  AFTs are not able to provide quick and inexpensive justice to members of the Armed Forces and the retired personnel due to the large vacancies in the benches.

The Ex Service men of the Country earnestly request the Prime Minister and the Defence Minister to ensure that the vacancies in the benches of AFTs are filled on a war footing so that they can dispense justice to the defenders of the Nation. We request the Hon'ble Chief Justice of India to use his judicial might in the matter so that the forum of justice provided to the ESM doesn't become a farce.
