Iranian authorities have long been pursuing a strategy to eradicate independent and authentic civic action. Civic space is shrinking at an alarming rate, and authorities use all means to spread and promote a phobia of civil society. Civil society activists, especially environmental activists, labor union and teacher union activists, as well as human rights defenders have been wrongfully persecuted. Eight environmental activists are sitting in prison on charges of espionage, four of whom are additionally charged with “sowing corruption on earth”. If convicted, they will face death penalty.

Another environmental expert, Dr. Kavous Seyed Emami, died in detention, and the circumstances of his death are unclear.

Human rights defenders and lawyers are targeted with extreme persecution and unjust sentencing, as is the case of Nasrin Sotoudeh -- human rights lawyer -- sentenced to 38 years of prison and 148 lashes, or Nargess Mohammadi -- a human rights defender -- sentenced to 16 years in prison.

The Iranian Parliament is now looking into passing a draft bill to create and put in force a Media Council, which, if passed into law, will be in charge of issuance or cancellation of journalist license and put an end to independent journalism in Iran.

These human rights violations are enhanced by the fact that the judiciary does not act independently and does not follow due processes when handing judgements on human rights defenders.

Given this closed civic space and impunity on the part of Iranian authorities, we urge our civil society partners to join this petition to call for greater accountability for human rights violations in Iran.

WE, the undersigned, call on the Government of Iran to create and maintain, in law and in practice, an enabling environment for Iranian civil society activists and organizations, in accordance with the rights enshrined in the UN Declaration on Human Rights, the ICCPR, the UN Declaration on Human Rights Defenders and Human Rights Council resolutions 22/6, 27/5 and 27/31.

In light of the restrictions facing civil society in Iran we call on Iranian authorities for the following:

-- Respect the civic right of its citizens to establish and actively engage with civil society organizations in full independence, and remove legal and policy measures that unwarrantedly limit the right to association and assembly.

-- Recognize the right of its citizens to peaceful assembly, and adopt a policy which, in accordance with international standards, requires a simple notification of assemblies being held, rather than explicit permission being needed to assemble.

-- Legalize the existence of labor unions and create an enabling environment for them, as per ILO’s Conventions CO87 and CO98, to raise issues affecting their members without fear of intimidation or arrest.

-- Refrain from the practice of associating the work of civil society with unfounded accusations that are linked to the security of the state, and ensure that civil society representatives are able to carry out their legitimate activities without fear of undue hindrance, obstruction or legal and administrative harassment.

-- Amend all restrictive provisions of the Code of Criminal Procedure and the Cyber Crime Laws, so that they are in line with international human rights and civil society standards.

-- Refrain from adopting any laws, including the IRI Media Council, providing for censorship or undue control over the content of the media, both social and conventional, and ensure that freedom of expression is safeguarded in all forms.

-- Unconditionally and immediately release all civil society representatives, human rights defenders and citizens who have been detained for exercising their fundamental rights to the freedoms of association, peaceful assembly and expression.

آزادی انجمن‌ها و تجمعات در ایران: درخواست اقدام فوری

مقامات ایران همواره در طول سالهای گذشته سرکوب و نابودی جامعه مدنی مستقل  را در دستور قرار داده‌اند. در شرایط کنونی فضای مدنی به میزان هشداردهنده‌ای بسته شده است و مسئولان از هیچ روشی برای بسط گفتارهای جامعه مدنی هراسی فروگذار نمی‌کنند. فعالان جامعه مدنی، خصوصا فعالان محیط زیست، فعالان حوزه کارگری، فعالان اتحادیه‌های کارگری و اتحادیه معلمان، و مدافعان حقوق بشر با اتهامات بی‌اساس تحت پیگرد قضایی قرار دارند. هشت فعال محیط زیست هم‌اکنون با اتهامات مرتبط به جاسوسی در زندان‌های ایران زندانی‌اند. چهار نفر از آن‌ها اتهام سنگین دیگری را با عنوان «فساد فی‌الارض» در پرونده دارند. اتهاماتی که می‌تواند در صورت پابرجا ماندن حکم مرگ به همراه داشته باشد.

این در حالی است که دکتر کاووس سید امامی، یکی دیگر از فعالان متخصص محیط زیست، که او نیز در بازداشت به سر می‌برد، در زندان جان سپرد و شرایطی که منجر به مرگ او شده است همچنان نامشخص است.

مدافعان حقوق بشر و وکلای آن‌ها هدف اذیت و آزار شدید و احکام غیرعادلانه هستند. از آن میان می‌توان به پرونده نسرین ستوده، یک وکیل حقوق بشری، اشاره کرد که به تحمل ۳۸ سال زندان و ۱۴۸ ضربه شلاق محکوم شده است. یا می‌توان به پرونده نرگس محمدی، یکی از مدافعان حقوق بشر در ایران، اشاره کرد که به علت فعالیت‌های صلح‌آمیز خود به ۱۶ سال زندان محکوم شده است.

دولت ایران همچنین همواره در تلاش بوده است تا آزادی بیان را محدود کند. هم‌اکنون مجلس شورای اسلامی در حال بررسی طرحی تحت عنوان «سازمان نظام رسانه‌ای» است تا به موجب آن سازمانی شکل گیرد، که در صورت تصویب، مسئولیت اعطا یا لغو مجوز کار روزنامه‌نگاران را بر عهده خواهد داشت و می‌توان از آن به مثابه مرگ روزنامه‌نگاری مستقل در ایران نام برد.

نقض حقوق بشر در ایران به علت عدم استقلال دستگاه قضایی با وخامت بیش‌تری رو به رو است. از همین رو و با توجه به فضای بسته مدنی در ایران و مصونیت مقامات ایران از مجازات، ما از شرکای خود در عرصه جامعه مدنی می‌خواهیم تا به ما بپیوندند و با امضای این طومار خواستار پاسخگویی مقامات ایران در زمینه نقض گسترده حقوق بشر شوند.

درخواست‌های اصلی:

ما، امضاء کنندگان این طومار، از دولت ایران می‌خواهیم که مطابق اعلامیه حقوق بشر سازمان ملل متحد، ICCPR، بیانیه ملل متحد در ارتباط با مدافعان حقوق بشر، و قطعنامه‌های 22/6، 27/5 و 27/31  شورای حقوق بشر ملل متحد، در قانون و در اجرا شرایط مناسبی را برای فعالان و سازمان‌های جامعه مدنی ایرانی ایجاد کند و در تداوم آن بکوشد.

ما همچنین در ارتباط با محدودیت‌های جامعه مدنی در ایران از دولت ایران می‌خواهیم که:

به حقوق مدنی شهروندان خود برای ایجاد و فعالیت آزادانه و مستقل سازمان‌های جامعه مدنی احترام بگذارد و هرگونه قانون یا رویه‌ای را که به صورت ناعادلانه حق آزادی تجمعات و انجمن‌ها را در ایران محدود می‌کند لغو یا از دستور کار خارج کند.
حق تجمع صلح‌آمیز شهروندان را به رسمیت بشناسد و سیاستی را در در این باره در پیش بگیرد که مطابق استانداردهای بین‌المللی باشد و برای برگزاری تجمع صلح‌آمیز تنها باید به خبر دادن به مقامات مرتبط نیاز باشد و نه به کسب «مجوز» رسمی.
اتحادیه‌های کارگری را قانونی تلقی کند و محیطی برای آن‌ها فراهم آورد تا این اتحادیه‌ها بتوانند بر اساس کنوانسیون‌های CO87 و CO98 سازمان بین‌المللی کار، بدون ترس از بازداشت و دیگر عواقب امنیتی آزادانه به موضوعاتی بپردازند که زندگی و کار اعضای آن‌ها را تحت تاثیر قرار می‌دهد.  
از گره زدن فعالیت‌های مدنی با اتهامات بی‌اساس امنیتی بپرهیزد، و امکان فعالیت مشروع فعالان مدنی را بی‌آنکه با مانع یا آزار و اذیت قانونی و اداری مواجه شوند، تضمین کند.
همه محدودیت‌های تعریف‌شده در قوانین کیفری و قوانین جرایم سایبری را اصلاح کند به طوری که با استانداردهای بین‌المللی حقوق بشر و جامعه مدنی مطابقت پیدا کنند.
از تصویب هرگونه قانون، از جمله سازمان نظام رسانه‌ای جمهوری اسلامی، که سانسور یا کنترل محتوای رسانه‌های مرسوم و یا شبکه‌های اجتماعی آن‌لاین را ممکن می‌کند بپرهیزد و اطمینان حاصل کند که آزادی بیان در همه اشکال محافظت می‌شود.
فورا، بدون قید و شرط همه نمایندگان جامعه مدنی، مدافعان حقوق بشر و شهروندانی را که به علت دفاع و بهره‌گیری از حقوق بنیادین خود در زمینه آزادی انجمن‌ها، تجمعات صلح‌آمیز و آزادی بیان دستگیر شده‌اند، آزاد کند.

Liberté d'association et de réunion en Iran: appel à une action urgente
 

Les autorités iraniennes poursuivent depuis longtemps une stratégie visant à éliminer l'action citoyenne indépendante et authentique. L'espace civique diminue à une vitesse alarmante et les autorités font usage de tous les moyens à leur disposition pour diffuser et promouvoir une phobie contre la société civile. Des militants de la société civile, notamment des défenseurs de l'environnement, des militants syndicalistes et des syndicats des enseignants, ainsi que des défenseurs des droits de l'homme ont été injustement persécutés. Huit militants écologistes sont en prison pour espionnage, dont quatre ont été accusés de « semer la corruption au niveau mondial ». S'ils sont reconnus coupables, ils risquent la peine de mort.

Un autre expert de l’environnement, le Dr. Kavous Seyed Emami, est décédé lors de sa détention, et les circonstances de son décès restent peu claires.

Les défenseurs et les avocats des droits de l’homme font face à une persécution extrême et à des condamnations injustes. C’est le cas de Nasrin Sotoudeh - avocate spécialiste des droits de l’homme - condamnée à 38 ans de prison et 148 coups de fouet ou de Nargess Mohammadi - défenseur des droits de l’homme - condamnée à 16 ans de prison.

Actuellement, le Parlement iranien étudie la possibilité de faire adopter un projet de loi visant à créer et à mettre en vigueur un Conseil des médias qui, s’il était adopté, serait chargé de délivrer ou d’annuler la licence de journaliste et de mettre fin au journalisme indépendant en Iran.

Ces violations des droits de l'homme sont exacerbées par le fait que le pouvoir judiciaire n'agit pas de manière indépendante et ne respecte pas les procédures établies lorsqu'il rend des jugements à des défenseurs des droits de l'homme.

Compte tenu de cet espace civique fermé et de l'impunité des autorités iraniennes, nous exhortons nos partenaires de la société civile à se joindre à cette pétition pour exiger davantage de responsabilité pour les violations des droits de l’homme en Iran.

 

Tâches spécifiques:

Nous, soussignés, appelons le gouvernement iranien à créer et à maintenir, sur le plan législatif et en pratique, un environnement favorable pour les militants et les organisations de la société civile iranienne, conformément aux droits énoncés dans la Déclaration universelle des Droits de l'Homme des Nations Unies, au Pacte international relatif aux droits civils et politiques (PIDCP), à la Déclaration des Nations Unies sur les défenseurs des droits de l'homme et aux résolutions 22/6, 27/5 et 27/31 du Conseil des droits de l'homme.

Compte tenu des restrictions auxquelles est confrontée la société civile iranienne, nous demandons aux autorités iraniennes à prendre les mesures suivantes :

·       Respecter le droit civique de ses citoyens de constituer des organisations de la société civile en toute indépendance et d'y participer activement, et d'éliminer les mesures juridiques et politiques limitant de manière injustifiée le droit d'association et de réunion.

·       Reconnaître le droit de ses citoyens de se réunir pacifiquement et adopter une politique qui, conformément aux normes internationales, requiert une simple notification pour la tenue de réunions, au lieu d'une autorisation explicite de réunion.

·       Légaliser l'existence des syndicats et créer un environnement favorisant leur participation, conformément aux conventions CO87 et CO98 de l'Organisation Internationale du Travail, afin de soulever les problèmes impactant leur membres sans craindre sans craindre d'être menacés ou arrêtés.

·       S'abstenir d'associer le travail de la société civile à des accusations sans fondement, liées à la sécurité de l'État. Veiller à ce que les représentants de la société civile puissent mener à bien leurs activités légitimes sans crainte des obstacles injustes, des obstructions ou harcèlement judiciaire ou administrative. 

·       Modifier toutes les dispositions restrictives du Code de procédure pénale et des lois sur la cybercriminalité, afin qu'elles soient conformes aux normes internationales en matière de droits de l'homme et de la société civile.

·       S'abstenir d'adopter toute loi, y compris le Conseil des médias IRI, prévoyant une censure ou un contrôle excessif sur le contenu des médias, tant sociaux que conventionnels, et garantir la protection de la liberté d'expression sous toutes ses formes.

·       Libérer immédiatement et sans condition tous les représentants de la société civile, les défenseurs des droits de l'homme et les citoyens arrêtés pour avoir exercé leurs droits fondamentaux de liberté d'association, de réunion pacifique et d'expression.

حرية تكوين الجمعيات والتجمّع في إيران 

دعوة لتحرّك عاجل

تتّبع السلطات الإيرانية منذ وقت طويل استراتيجيةً هدفُها القضاء على العمل المدني الحقيقي والمستقل. فالحيّز المدني يتقلص بوتيرة تُنذر بالخطر، والسلطات تستخدم كل الوسائل لنشر الخوف من المجتمع المدني. كما يتعرّض النشطاء في المجتمع المدني للاضطهاد بشكل سافر، خاصة منهم النشطاء في مجال البيئة والنقابات العمالية ونقابات المدرّسين، فضلاً عن المدافعين عن حقوق الإنسان. وحاليا يقبع ثمانية من نشطاء البيئة في السجن بِتُهم تتعلق بالتجسّس، كما أنّ أربعة منهم متّهمون بـ"الإفساد في الأرض"، وإذا ما تمّت إدانتهم، فسيواجهون عقوبة الإعدام.

خبير في مجال البيئة، وهو الدكتور كافوس سيد إمامي، تُوفّي وهو رهن  الإحتجاز، ولا تزال ظروف وفاته غامضة.

يتعرض نشطاء حقوق الإنسان والمحامون إلى الاضطهاد الشديد والأحكام الجائرة، كما هو الحال مع المحامية المدافعة عن حقوق الإنسان نسرين سوتوده، المحكوم عليها بالسجن لمدة 38 عاماً و148 جلدة، والمدافعة عن حقوق الإنسان نرجس محمدي، المحكوم عليها بالسجن لمدة 16 عاماً.

من ناحية أخرى، يسعى البرلمان الإيراني حاليا لتمرير مشروع قانون لإنشاء وتفعيل مجلس للإعلام. وفي حالة إقراره، سيَمنح هذا القانون للمجلس صلاحيات إصدار أو إلغاء التراخيص للصحفيين، وهو ما يعني تقويض الصحافة المستقلة في إيران.

ومما يُعزز هذه الانتهاكات لحقوق الإنسان أنّ الجهاز القضائي لا يعمل بشكل مستقل ولا يتّبع الإجراءات القانونية السليمة عند إصدار الأحكام على نشطاء حقوق الإنسان.

لذلك وبالنظر إلى هذا الحيز المدني المغلق ومناخ الإفلات من العقاب السائد لدى السلطات الإيرانية، فإننا نحثّ شركائنا من المجتمع المدني على الانضمام إلى هذه العريضة للمطالبة بمزيد من المساءلة عن انتهاكات حقوق الإنسان في إيران.

مهام محددة :

نحن الموقعين أدناه، ندعو الحكومة الإيرانية إلى تهيئة وصون بيئة تمكينية، في القانون وفي الممارسة، لنشطاء ومنظمات المجتمع المدني الإيراني، وفقاً للحقوق المنصوص عليها في الإعلان العالمي لحقوق الإنسان والعهد الدولي الخاص بالحقوق المدنية والسياسية وإعلان الأمم المتحدة بشأن المدافعين عن حقوق الإنسان وقرارات مجلس حقوق الإنسان 22/6 و27/5  و27/31.

وبالنظر إلى ما يواجه المجتمع المدني في إيران من قيود، فإننا ندعو السلطات الإيرانية إلى ما يلي:

§      اﺣﺘﺮام اﻟﺤﻖ اﻟﻤﺪﻧﻲ لمواطنيها ﻓﻲ إﻧﺸﺎء ﻣﻨﻈﻤﺎت اﻟﻤﺠﺘﻤﻊ اﻟﻤﺪﻧﻲ واﻟﻤﺸﺎركة الفاعلة ﻓﻴﻬﺎ باستقلالية تامة،  وإلغاء اﻟﺘﺪاﺑﻴﺮ اﻟﻘﺎﻧﻮﻧﻴﺔ واﻟﺴﻴﺎﺳات اﻟﺘﻲ ﺗﺤدّ، على نحو غير مبرر، ﻣﻦ حرية تكوين الجمعيات والتجمع؛

§      الاعتراف بحقّ مواطنيها في التجمّع السلمي، واعتماد نظام الإخطار بالتجمّعات بدلاً من نظام الإذن المُسبق، وذلك وفقا للمعايير الدولية؛

§      إضفاء الطابع القانوني على وجود النقابات العمالية وتهيئة بيئة مواتية لها، وذلك بموجب اتفاقيات منظمة العمل الدولية رقم 87 و 98 ، بما يمكّنها من إثارة المسائل المتعلقة بأعضائها دون الخوف من التعرّض للترهيب أو الاعتقال؛

§      الإحجام عن ربط عمل المجتمع المدني باتهامات باطلة تتعلق بأمن الدولة، وضمان أنْ يكون ممثلو المجتمع المدني قادرين على القيام بأنشطتهم المشروعة دون الخوف من فرض قيود مفرطة على عملهم أو عرقلته أو التعرّض لمضايقات قانونية وإدارية؛

§      تعديل جميع الأحكام التقييدية الواردة في قانون الإجراءات الجنائية والقوانين المتعلقة بجرائم الإنترنات، بحيث تتماشى مع المعايير الدولية لحقوق الإنسان والمجتمع المدني؛

§      الامتناع عن إقرار أيّة قوانين، بما في ذلك القانون المتعلق بإحداث مجلس الإعلام، تنصّ على الرقابة على وسائل الإعلام التقليدية ووسائل التواصل الاجتماعي أو المراقبة غير المبرّرة للمحتوى الإعلامي، وضمان حماية حرية التعبير بجميع أشكالها.

§      الإفراج الفوري وغير المشروط عن جميع ممثلي المجتمع المدني والمدافعين عن حقوق الإنسان والمواطنين المحتجَزين بسبب ممارستهم لحقوقهم الأساسية في حرية تكوين الجمعيات والتجمع السلمي والتعبير.
