Why this petition matters

Started by Will Dobbins

I wrote this petition hopes of spurring a minor change to our Iowa Code to enhance the utilization of our state's amazing network of trails and enhance access to our natural  resources for many of our citizens.  Currently Iowa Code 321.1 20B (I think I'm citing this right) has two words that restrict it greatly and benefit only owners of Segways.  Removal of "nontandem two-" would update this code to include a wide variety of qualifying devices and make it more in line with the national ADA stance that technology is quickly evolving and personal mobility devices are benefitting from this greatly.

321.1
20B. “Electric personal assistive mobility device” means a self-balancing, nontandem two-wheeled device powered by an electric propulsion system that averages seven hundred fifty watts and is designed to transport one person, with a maximum speed on a paved level surface of less than twenty miles per hour. The maximum speed shall be calculated based on operation of the device by a person who weighs one hundred seventy pounds when the device is powered solely by the electric propulsion system. For purposes of this chapter, “electric personal assistive mobility device” does not include an assistive device as defined in section 216E.1.

Examples of devices this change would allow includes but not be limited to Electric Unicycles, Electric Mountain Boards, Electric Skateboards, OneWheels, Electric Scooters, etc.

Current definition of Iowa Code lumps these into 'motorized vehicles' which are prohibited for safety reasons from our state's vast network of trails and limits the accessibility and enjoyment of these trails for many of our citizens.  I feel this is likely an oversight of the language used as the devices fall well within the requirements to be operated safely with the exception of the number of wheels and/or configuration of wheels they have.  (My research shows this language was lobbied for by Segway and as such is very specific to their flagship product.)
