I recently visited Bawarchi Biryanis, one of my favorite restaurants in the Chicago suburb area, specifically Bawarchi Naperville located at 4250 Fox Valley Center Dr, Aurora, IL 60504.  I unfortunately learned that if a customer provides a tip with a credit or debit card, the owner takes the tips, and that the employees only receive the tips if they are in cash.

I was appalled by this and felt this practice should not be legal.  And I believe it is not legal, according to the Fair Labor Standards Act 2018.  You can read the provisions here, https://www.dol.gov/whd/regs/compliance/whdfs15.htm that state that no owner should take employees' tips for any reason.

I wanted to bring this to the attention of the public to allow these workers, these waiters and servers, to receive their fair share.  Especially as we live in an age where more and more customers pay card-only and don't happen to carry cash.

Hopefully the ACLU, or some other such agency, can represent these employees to notify them of their legal rights and represent them to bring litigation against the owner to end this practice of tip-taking and receive their due.

I hope that this can be resolved, because I really would not like to boycott what is really one of my truly favorite restaurants.
