Why this petition matters

Started by Richard Chu

Dear Attorney General Kittipromwong,

Today, myself and the undersigned request that the Thai law be amended to allow consanguineous marriage. The reason is as follows:
At the present time, Thai law permits consanguineous relationships but does not allow consanguineous marriage. Incest between consenting adults is legal in Thailand , but Thai law discriminates against incestuously oriented consenting adult (CIAO) people by prohibiting them from marrying, even if they have children. This discrimination is not only quite unfair and harmful to the lives of CIAO people, but also unconstitutional.
The Thai Constitution says in Section 4.
'Human dignity, rights, liberties and equality of the people shall be protected. The Thai people shall enjoy equal protection under the Constitution."
Section 27. also says 'All persons are equal before the law,and shall have rights and liberties and be protected equally under the law. Men and women shall enjoy equal rights. Unjust discrimination against a person on the grounds of differences in origin, race, language, sex, age, disability, physical or health condition, personal status, economic and social standing, religious belief, education, or political view which is not contrary to the provisions of the Constitution or on any other grounds, shall not be permitted
The Thai Constitution thus promises equal rights and prohibits discrimination, and so it there seems to be no valid reason for CIAO people to be prohibited from marrying. CIAO people may have children and they need to be protected by the law and have the same legal rights as other children are who have legally married parents. CIAO people and their children should not be subjected to social stigma or institutional incestophobia. They should not be deprived of rights that others have who are in consensual adult relationships: for example: the right to marry the person they love, and the right to have a mother and a father who are legally married to each other. The right to inherit from a legal parent or partner.

Not all CIAO people may want to marry, but those who wish to marry should not be legally barred from doing so. To refuse to allow them to marry is a breach of their civil and constitutional rights, and to treat them as different from other people is to discriminate against them.
All people who believe in equality and human rights should support the rights of CIAO people to marry in Thailand.

As the Attorney General of Thailand, will you please initiate the necessary reforms of Thailand's laws so that in future, CIAO people who wish to marry are able to do so. By taking action on this matter, I think you will help raise public confidence in the integrity of both the Thai Constitution and the OAG.
Your help in this matter will be highly appreciated by myself and by many domestically and international who care about the human rights of CIAO communities around the world
Thank you very much on behalf of CIAO people everywhere today and in the future.

Yours sincerely,

Richard Morris
(Founder and Director of the International CIAO Rights Association)
