Objective: Exonerate Marcus Malone

Marcus Malone was 17 years old when he was arrested for the murder of Alana Tello in 2016. The tragic incident took place at Zodiac Park where there was reported to have been a physical altercation where Marcus was present. After his arrest, Marcus maintained his innocence. There was no physical evidence against Marcus and several of the victims identified someone else as Tello’s killer. In spite of the lack of evidence, or connection to the crime, Marcus was convicted of murdering Alana Tello.  He was sentenced to 133 years in prison in January of 2020. 

Here are facts, of Marcus Malone’s case:

• The victims and other witnesses at the scene identified a different man as Tello’s killer and reported to the police that they had arrested “the wrong guy” at the time of Marcus’s arrest.
• The man who the victims identified to be the killer was never arrested, though he had motive and a connection to the victims.
  The suspects at the crime scene were reported to be members of a violent gang and had criminal histories.
• Though Marcus had no prior criminal record, he was the only suspect convicted of murder and assault.
• After Marcus was arrested, at age 17, he was interrogated for over 3 hours without a parent or guardian present; or video or audio recording
• The police have no physical evidence against Marcus. Their only evidence against him in trial was the testimony of the other gang suspects who were present when Tello was murdered.
• All of the statements that accused Marcus of the shooting are inconsistent and tell different versions of what happened. The statements of the witnesses who reported that Marcus did not commit the murder are all the same.
• When Marcus was arrested in 2016 and placed in the Shelby County Jail his bail was set at $2 million dollars.
• Marcus Malone was held for 4 years in the Shelby County Jail before he was convicted in 2019. Although Marcus was a minor at the time of his arrest, he was sentenced as an adult at his trial.
