Recently, the rights of indigenous peoples in Brazil were attacked in the House of Representatives with the approval of Bill 490 (now Bill 2903/2023). The repercussions were immediate and the image that was passed to the world was that the country is raffling off human rights in exchange for a supposed "progress". But the fight is not over! Indigenous peoples and civil society are mobilized because the battle is now in the Federal Senate, for the rejection of the bill, and in the Federal Supreme Court, against the temporal milestone. WE MUST UNITE TO GUARANTEE THE SURVIVAL OF THE INDIGENOUS PEOPLES OF BRAZIL!

The death sentence for indigenous peoples, known as Bill 2903/20223 brings extremely worrying proposals, such as:

the possibility of reviewing the demarcations of already consolidated indigenous lands;
the transfer of the competence of demarcation to Congress and
the modification of the temporal landmark criterion for land demarcation - here, indigenous peoples would only have the right to lands that were under their possession on October 5, 1988, or that were in physical or judicial dispute at that date.
While the indigenous people fight for a dignified life on their originally occupied lands, the ruralists, gold miners, large landowners, land grabbers, and other allies try to make the demarcation impossible by using the unconstitutional thesis of the temporal limit. A real coordinated attack! The Senate needs to stop this! Senators need to remember that the historical violence of persecution and murder that the indigenous peoples suffered (and suffer), resulted (and result) in several expulsions - even before the Constitution of 88.

The trial of the thesis of the temporal milestone in the Federal Supreme Court will resume with the score tied at 1-1. With general repercussion, if approved, the impact of this measure will be gigantic! It will interfere in the entire process of demarcation of indigenous lands, including those already completed, those in the study phase, and future processes. The Court, as the highest house of the judiciary, has the opportunity to correct this historic error and finally guarantee the justice that the Constitution determined should be done to the native peoples.
