On April 7, 2015, the Arkansas Senate passed Act 1235 SB 978 prohibiting the online sales of e-juice and vape related products. This effectively created a bubble in the industry, fostering economic strife and limiting a consumer’s right to choose. By prohibiting online sales of vape products, legislators are restricting growth in an otherwise growing market, cutting out much needed jobs and tax revenue. For the consumer, that means a limited choice not only in quantity of product, but also in quality. In addition to economic strife and a violation of consumer rights, a ban on vape products creates a black market outside of FDA regulations. Uninformed consumers are left with low quality products that could result in injury or death. Much like the alcohol prohibition in the 1920’s, banning something does not make the issue disappear. Without the repeal of Act 1235 SB 978, a failed part of history will have the opportunity to repeat itself.
