Why this petition matters

Started by Anthony Smith

Help those falsely accused of mental illness and whose rights to not be involuntarily held or committed are in direct violation of the "Dangerousness Standard" and other pertinent judicial criteria for court ordered detention as prefaced by the case history of 'O'Connor V. Donaldson' case #: 422 U.S.563 (1975).

If we win people negatively impacted (such as those who have been 'socially defeated' by and made homeless and lost jobs etc. from plenary action of either psychiatrists themselves or their judiciary governing bodies which oversee them) to involuntary holds by punitive psychiatric abuses possibly first in Franklin County Ohio will have a horse in the race against injustices.

Katherine McDonald of Cincinnati College of Law and I agree that 'judicial reforms' should take place in the areas of involuntary commitment globally (for example: https://scholarship.law.uc.edu/cgi/viewcontent.cgi?article=1298&context=uclr I am advocating for a similar judicial reform involving 'Emergency Holds' where there would be more steps in-place (such as in criminal procedure the 'Miranda Right' or homologous equivalent for 'clinical psychiatric' law enforcement ) to ensure criteria was being justly met and of course retain the right to a trial ;)
