Subject: Violation of Human and International Rights of Refugees by Turkish Immigration Office and UNHCR

We the undersigned testify that the human and legal rights of refugees in Turkey are abrogated systematically by the UNHCR and the Turkish Immigration Office.

In late 2018, the UNHCR formally handed over the review of refugees’ cases to the Turkish Immigration Office. Since then, the Immigration Office has rejected most of the cases on an unprecedented scale, served many refugees with notices of leaving Turkish territory, and in some cases has deported refugees. And this process is continuing. All this is happening while according to the Geneva Conventions none of the refugees who have been accepted by the UNHCR and are under international protection should under any circumstances be returned to their countries of origin. 

In an explicit violation of international law, the Turkish Immigration Office has even rejected those refugees whose cases were certified by the UNHCR. Now most of these refugees are in a state of uncertainty and at risk of deportation, while the UNHCR is only watching on the sidelines and doing nothing. These refugees were not given ID cards (known as Kimlik) in most cases and their appeals in Turkish courts will lead to no result.

In another case of refugee rights abrogation, Turkey’s Immigration Office cut off the refugees’ healthcare insurance a few months ago. That is while most refugees are sick physically and mentally due to living under terrible conditions for many years. As they are not able to pay for their healthcare, they won’t be able to go to the doctor, and things will only become worse for them.

In case of the COVID-19 outbreak, for which most Turkish poor families received aid from the government, refugees were denied any kind of financial, material or even moral support. And that is while most of them have lost their jobs as a result of the pandemic and are living under terrible circumstances.

Instead of being a place for solving the refugees’ problems and helping them, the Turkish Immigration Office has turned into a place of fear where most refugees prefer not to go to unless they must. It looks like Turkish authorities have made sure to do everything to humiliate and mistreat the refugees and trample their human and legal rights. As such, we believe that there is no will by either the Turkish Immigration Office or by the UNHCR to address the predicaments of the refugees in Turkey.

Hereby, we the undersigned, who include a wide range of refugees and activists from different nationalities, ask of the highest judicial authority of Europe, the European Court of Human Rights, to kindly address the situation of the refugees in Turkey and help solve their problems. In case there is a need for witness testimony, either at court or via Internet, there are many who will be more than willing to testify.

موضوع: نقض حقوق انسانی و بین المللی پناهندگان توسط اداره مهاجرت دولت ترکیه و کمیساریای عالی پناهندگان

ما امضاء کنندگان این نامه شهادت میدهیم که حقوق انسانی و قانونی پناهندگان در ترکیه از طرف اداره مهاجرت این کشور و دفتر کمیساریای عالی پناهندگان در ترکیه به طور سیستماتیک نقض میشود.

پس از آنکه در اواخر سال ۲۰۱۸، کمیساریای عالی پناهندگان سازمان ملل در ترکیه به طور رسمی، روند بررسی پرونده های پناهندگان را به اداره مهاجرت ترکیه واگذار نمود، این اداره در اقدامی کم سابقه، پرونده بسیاری از پناهندگان را رد نمود، به آنان حکم ترک خاک داد و برخی را هم دیپورت کرد، روندی که تا به امروز ادامه دارد.

این در حالیست که مطابق کنوانسیون ژنو، پناهنده ای که مطابق قوانین بین المللی، پناهندگیش پذیرفته شده و زیر چتر حمایتی کمیساریای عالی پناهندگان قرار دارد، نباید تحت هیچ شرایطی به کشور مبدا خود مسترد شود. نقض قوانین تا آنجا پیش رفت که پناهنده های بسیاری هم که قبولی کمیساریا را داشتند، ردی گرفتند و اکنون بسیاری از آنان در وضعیت بلاتکلیف و خطر دیپورت قرار دارند. در بسیاری موارد به این پناهندگان کیملیک داده نمیشود و شکایت آنها هم در دادگاههای ترکیه به جایی نمیرسد.

در اقدامی دیگر از نقض حقوق پناهندگان، ظرف چندین ماه گذشته، بیمه پزشکی پناهندگان قطع شده و بسیاری از آنان که به دلیل زندگی طاقت فرسای چندساله در ترکیه، دچار انواع بیماریهای جسمی و روحی شده اند، به حال خود رها شده اند و از تامین مخارج پزشکی خود ناتوانند و اکثرا روند بیماری آنها تشدید شده است.
اداره مهاجرت ترکیه به جای آنکه مامنی برای پناهندگان و حل مشکلات آنان باشد، به مکانی رعب آور و ترسناک برای پناهندگان تبدیل شده که خیلیها از رفتن به آنجا وحشت دارند. پناهندگان به اشکال مختلف و سازمان یافته تحقیر میشوند و مورد اهانت قرار میگیرند و حقوق انسانی آنان به روشهای مختلف پایمال میشود. در شرایط شیوع ویروس کرونا و بیکاری گسترده پناهندگان، دولت ترکیه به شهروندان خود کمک مالی نمود، اما به پناهندگان از هیچ جایی کمک نرسید و اکنون هم در شرایط معیشتی بسیار سختی قرار دارند.

ما بر این باوریم که نه از طرف اداره مهاجرت و نه از طرف کمیساریا، هیچ اراده ای به سر و سامان دادن به وضعیت پناهندگان در ترکیه وجود ندارد و ارسال پرونده های پناهندگانی که قبولی کمیساریا را دارند به اداره مهاجرت، نقض قوانین پناهندگی و کنوانسیون ژنو است.

ما امضاکنندگان این نامه که طیف وسیعی از پناهندگان از ملیتهای مختلف را شامل میشود، از بالاترین مرجع حقوق بشر اروپا خواستاریم در شرایطی که سیستم قضایی ترکیه نمیتواند و یا نمیخواهد از حقوق پناهندگان دادخواهی کند، شما به طرفیت از ما به این وضعیت اسفبار رسیدگی کنید.

چنانچه در دادگاه شاهد به صورت حضوری و یا از طریق تماس اینترنتی لازم باشد، افراد زیادی حاضر به شهادت در این رابطه میباشند.

Objet: Violation des droits de l'homme et des réfugiés internationaux par l'Office turc des migrations et le Haut-Commissaire pour les réfugiés.

Bonjour Madame, Monsieur,

Nous, signataires de cette lettre, témoignons que les droits humains et légaux des réfugiés en Turquie sont systématiquement violés par l'Office turc des migrations et le Haut-Commissariat aux réfugiés en Turquie. Après que le Haut-Commissariat des Nations Unies pour les réfugiés (HCR) a officiellement remis la procédure d'asile au service d'immigration turc fin 2018, l'agence a rejeté de nombreux demandeurs d'asile dans une démarche sans précédent. Il a quitté le sol et en a déporté, un processus qui se poursuit encore aujourd'hui.

Cependant, selon les Conventions de Genève, un réfugié dont l'asile est accepté conformément au droit international et placé sous l'égide du Haut-Commissariat des Nations Unies pour les réfugiés ne doit en aucun cas être renvoyé dans son pays d'origine. Les violations de la loi sont allées si loin que de nombreux réfugiés qui ont été acceptés par le HCR ont été rejetés, et beaucoup sont maintenant dans un état d'incertitude et risquent d'être expulsés.

Dans de nombreux cas, ces réfugiés ne reçoivent pas Kimlik et leur plainte ne va nulle part devant les tribunaux turcs.
Dans un autre mouvement en violation des droits des réfugiés, l'assurance médicale pour les réfugiés a été supprimée au cours des derniers mois, et beaucoup de ceux qui ont souffert de diverses maladies physiques et mentales en raison de leurs années exténuantes de vivre en Turquie ont été libérés. Ils sont incapables de payer leurs frais médicaux et la plupart de leurs maladies ont empiré.
Au lieu d'être un refuge sûr pour les réfugiés et de résoudre leurs problèmes, le service d'immigration turc est devenu un endroit effrayant pour les réfugiés, dont beaucoup ont peur d'y aller. Les réfugiés sont humiliés et insultés de diverses manières et organisés, et leurs droits humains sont violés de diverses manières. Au milieu de l'épidémie de coronavirus et du chômage généralisé des réfugiés, le gouvernement turc a fourni une aide financière à ses citoyens, mais aucune assistance n'a été fournie aux réfugiés et ils vivent toujours dans des conditions de vie très difficiles.

Nous pensons que ni l'Office suédois des migrations ni le HCR n'ont la volonté de résoudre la situation des réfugiés en Turquie et de renvoyer les cas de réfugiés à l'Office des migrations, en violation des règles d'asile et de la Convention. C'est Genève.

Nous, signataires de cette lettre, qui comprend un large éventail de réfugiés de différentes nationalités, demandons à la plus haute autorité européenne des droits de l'homme de remédier à notre sort dans une situation où la justice turque ne peut pas ou ne veut pas poursuivre pour les droits des réfugiés. S'il est nécessaire de comparaître en personne ou par un appel en ligne, de nombreuses personnes sont prêtes à témoigner à cet égard.
