Elijah McClain was killed last summer by the Aurora Police and Fire department first responders. Rather than opening a case against against those officers, DA Dave Young decided to do nothing and open no further investigations into the death of a 23 year old young man. "Based on the investigation presented and the applicable Colorado law, there is no reasonable likelihood of success of proving any state crimes beyond a reasonable doubt at trial."

Dave Young released a statement later on June 25, 2020 outlining further why he refuses to take any action on this issue stating, " the role of the district attorney is to review investigations of criminal activity brought by law enforcement agencies within the jurisdiction" and continuing saying "The standard of proof for filing a criminal case is whether there is sufficient evidence to prove any
violation of law beyond a reasonable doubt." 

Dave Young's reasoning behind there not being enough evidence despite body camera evidence clearly outlining abuses of power by the police and fire department is that, "The forensic evidence revealed that the cause of death was undetermined. Specifically, the pathologist who conducted the autopsy stated that he was unable to conclude that the actions of any law enforcement officer caused Mr. McClain’s death." 

Elijah McClain was a 23 year old vegetarian. He died after suffering a heart attack en route to hospital after being bludgeoned by the police, placed in a choke hold, and then forcefully injected with ketamine. His death was not an accident. 

If Dave Young cannot recognize that the actions of the police and fire department lead to the death of Elijah McClain then he is not fit to serve the people of Aurora. Hiding from public comment by disabling his phone line is cowardly conduct unbecoming of someone in his position. We demand his immediate resignation and removal from any position of power within the government. It is clear his intention is not to serve the people who elected him, but to protect the police department and fire department at all costs.
