This Petition is addressed to the Houses of the Oireachtas pursuant to rules 125, 126, 127 of the Dail Standing Order Rules 2020.

The Petition requests that an independent Public Inquiry be had on behalf of We the People pursuant to the provisions of Rules 136, 137, 138 of the Dail Standing Order Rules 2020, on a matter of general public concern, which has resulted from the abuse of procedural process used in the Oireachtas to pass the Health (Preservation and Protection and other Emergency Measures in the Public Interest) Bill 2020, that has impacted and breached the inherent Fundamental Constitutional and Human Rights Interests of the People within this Nation.

We the People assert our Supreme Authority having the FINAL SAY from BUNREACHT NA hÉIREANN, specifically enumerated within the Preamble, Articles 1, and 6, to Petition for a Public Inquiry focused on the legitimacy of the dissolved 32nd Dáil Éireann in caretaker administration mode, wielding Executive Domination over the Oireachtas, most specifically the 33rd Dáil Éireann, to truncate and circumvent democratic due process after Re-assembly on 20th February 2020, up to passage of the Health (Preservation and Protection and other Emergency Measures in the Public Interest) Bill 2020 on 19th March 2020.

The People say, subsequent to reading the Proclamation, elected TD’s signing the Roll, Election of Ceann Comhairle, resignation of Leo Varadkar from office of TD and government, and purported visit to President Higgins at Áras an Uachtarán on the 20th February 2020, the Parliamentary procedure established at Rules 1, 3, 30, 173, 174, 200, 211, and 212 of Dáil Standing Orders 2020, is fraught with illegitimacy contrary to normal democratic process. This abuse of Dáil process and privileges, commenced at Business Committee level on 26th February 2020, and continued to the Debates in Dáil Éireann on the 5th & 19th of March 2020 (rules 30, 211, 212).

Un-elected TD Regina Doherty had no Constitutional, Statute law, or Standing orders mandate, to co-sponsor the Covid 19 Bill on the 16th March 2020 (rules 1, 212).                                                                                             The Ceann Camhoirle failed to Scrutinize the Bill (rules 30,173,174), and ensure a Certificate from the Attorney General was attached (rule 200).

 

What action are you suggesting in response to your petition?:

We say the People have legitimate expectations as a matter of public policy, that respect for their Human Rights, and the Constitutional mandate of a caretaker administration, (32nd Dáil) to perform their duties as regulated by the laws (Article 28.12) in effect at the time of Dissolution on 14th January 2020, must be obeyed. We DEMAND abuse and domination of the legislative process by the residual 32nd Dáil Éireann ministerial members within the Executive, to effectively operate arbitrarily without restriction, without a Constitutional mandate, and without Statute law footing as a purported in-functus officio government with full powers to pass laws, by misuse of a truncated and improperly constituted Oireachtas, be halted forthwith.

Those responsible for the illegitimacy in the parliamentary process, Fiasco surrounding initiation and passage of the Covid 19 Bill must be held to account for the resulting Fiasco of human suffering, loss of life, collapse of family life, and financial collapse of the economy.

A Referendum must be put to the People for the necessary changes to the Constitution and Statute law, to properly and clearly define by mandate, the role and limitations afforded to infuntus officio powers, of caretaker administrations in regard to initiation of legislation during an interregnum eg; (interval that exists when the State has no normal elected Prime Minister, especially between successive reigns of administrations)

We the People ask that this matter be given immediate attention. Your responsiveness to the undersigned Peoples concerns, and the concerns of those that sign on line, is necessary for harmony within the Peoples of the Nation.
