東京国際日本語学院（東京都新宿区）の講師は2020年1月に授業の合間に、精神疾患を抱える留学生に対して、日本の病院に通うのは迷惑、病気なら国へ帰れ、という趣旨の発言を行いました。(以下、生徒が録音した音声から引用）

「やっぱり日本人の基本の意見としては、あなたが何人でも関係ない。病気だったら国に帰りなさい。これは誰しもが言う意見です…〔中略〕それ(医療)を狙ってきてる悪い人がいっぱいいる中であなただけそういう意見はないって言ってもそれは…」

「最近では、外国人が留学ビザをとって、日本で医療申請を受けるっていうのが社会問題になっているの」

「それだったら日本に来たって独立してないとことか、むしろ日本のお金、税金を吸い取ってってるじゃない。それに対してはなんとも思わないわけ？」

通報者が自身が通院することが必要だということを説明しているのに、講師はそれを全否定しています。そして全く関係ない「外国人への医療が日本の税金を吸い取ってる」という偏見を持ちだし、一方的にハラスメントを行っています。

障がいを理由に生徒の学ぶ権利を否定し、外国人だからといい医療を受けるために国に帰れと促すのは明確な障がい者差別、外国人差別です。生徒を指導する立場にある講師がこのような発言を行っているなど言語道断です。

生徒を差別で追い込んでいった結果、生徒の精神状態が悪化し、自殺などにつながった場合、一体どうやって責任をとるつもりなのでしょうか。

 

教育機関である以上、学校はまず生徒を差別やハラスメントから守るべきです。

それゆえ、私たちは東京国際日本語学院に対し、以下のことを求めます。

o  差別発言を行った講師を解雇し、他にもこのような差別事例がないかについて内部調査を行うこと。
o  このようなことが二度と起こらないように、内部で差別禁止ルールを制定し、再発防止に努めること。

 

また、留学生に当校を紹介する機関もこうした差別・ハラスメントを見過ごしてはならず、これを批判する責任があると考えます。

ゆえに、当校を生徒に紹介している海外の留学機関に対しては以下のことを求めます：

o  当校が講師を解雇し、再発防止を行うまでは当校を生徒に紹介しないこと。
o  Moving Beyond Hate とともに当校の差別に反対すること。

 

近年、留学生の「失踪」や「留学生ビジネス」という日本語学校のずさんな管理・教育の問題が焦点化されています。しかし、これらは政府が進めてきた留学生受け入れ計画の下では野放しにされてきました。

また、一旦日本に来た留学生が在留資格を延長できるかは日本語学校の成績と出席率、そしてそれに基づく入管の審査によって決められます。学校と入管が生徒の在留資格の延長の可否を決定するような状況の下で留学生が差別に対して声を上げるのは困難です。

そんな中、通報者は勇気を振り絞って私たちMoving Beyond Hate に連絡してくれました。私たちは留学生の弱い立場につけこんだ非常に悪質なハラスメントに対して、断固として　「ＮＯ！」を突きつけます。

In January 2020, a teacher at the Tokyo International Japanese School (Shinjuku-ku, Tokyo) made these comments to a foreign student with a mental illness.

They said that going to a Japanese hospital would be problem and that if you are sick, you should go back to your own country. (The following is from the students recording.)

“It doesn't matter what country you’re from. If you are sick, go back to your country. All Japanese people have this opinion... [omission] and there are a lot of evil people who are after that (medical care)”

 “Recently, foreigners have been applying for student visas for the sole purpose of getting medical treatment in Japan. This is becoming a huge social problem”

 “In that case, even if you come to Japan, you are not independent. If anything, it seems that you are absorbing Japanese money and taxes. Don't you think that’s wrong?”

Although the student explains that they needed to go to the hospital, the teacher is completely unwilling to listen, and instead expresses the prejudice that "medical treatment for foreigners is sucking up Japanese taxes.". This is a completely one-sided harassment by the teacher.

Denying students' right to study on the basis of their disability and telling them to go back to their own countries for medical care just because they are a foreign citizen is blatant discrimination. It is outrageous that a teacher is making such remarks.

If a student's mental condition deteriorates as a result of discrimination, how is the school going to take responsibility?

Tokyo international Japanese School has an obligation to protect students from discrimination and harassment.

 

Therefore, we demand the following

o The Dismissal of the teacher who made these discriminatory remarks

o For the school to conduct an internal investigation on whether there have been other cases of such discrimination.

o For rules and measures be put in place to prevent the recurrence of such discrimination incidents.

 

In addition to this, Foreign exchange organizations that introduce the school to students abroad should not overlook such discrimination and harassment.

 

To overseas institutions that introduce the school to their students, we request the following:

o To stop introducing the school to students until the school has fired the instructor and put measures in place to prevent such incidents from happening again.

o To openly oppose the discrimination, together with Moving Beyond Hate

 

In recent years, problems of management and education in Japanese language schools have become the focus of attention. Students suddenly disappearing due to the bad school conditions are not uncommon.

However, such problems have been ignored under the government's policies to accept more foreign students.

Once a foreign student comes to Japan, whether they can extend their visa is determined by their grades, their attendance rate, and the Immigration Bureau's examination. As schools and the immigration bureau decide whether or not to extend the student's visa, it is very difficult for foreign students to speak out against discrimination.

Despite such difficulties, the student had the courage to contact Moving Beyond Hate.

 

We say "No!" to this harassment and discrimination.

학생에게 외국인 차별, 장애인 차별 발언을 한 일본어학교 강사의 해고와 재발 방지를 구합니다.
 

 도쿄국제일본어학원(도쿄도 신주쿠구)의 강사는 2020년 1월, 쉬는 시간 중에, 정신질환을 앓고 있는 유학생에 대해, 일본의 병원을 다니는 것은 일본에 폐를 끼치는 것이며, 아프면 모국으로 돌아가라는 취지의 발언을 했습니다. (이하, 학생이 녹음한 음성에서 인용)

 “역시 일본인의 의견으론, 네가 어떤 사람인지 관계 없어. 아프면 모국으로 돌아가. 이건 누구나가 생각하는 의견이야. <중략> 그걸(의료) 노리고 오는 나쁜 사람들이 많이 있는데 너만이 그런 뜻이 없다고 해도 그건…”

 “최근에, 외국인이 유학 비자를 받아서, 일본에서 의료를 받는 것이 사회적으로 문제시 되고있어.”

 “그럼 일본에 왔다 해도 부모로부터 독립하지 않았다는 것에 대해 반대로 생각해보면 일본의 돈, 세금을 빨아먹고 있는 거 아니니? 그것에 관해선 생각해본 적 없어?”

 제보자 자신이 병원을 다니는 것이 필요하다는 것을 설명하고 있는데, 강사는 그것을 전부 부정하고 있습니다. 그리고 전혀 관계없는 ‘외국인이 일본에서 의료제도를 받는 것이 일본의 세금을 빨아먹고 있다’는 편견을 꺼내, 일방적으로 하라스먼트를(이하, 갑질) 행하고 있습니다.

 장애를 이유로 학생의 배울 권리를 부정하고, 외국인이니 의료를 받고 싶으면 모국으로 귀국하라고 하는 것은 명확한 장애인 차별, 외국인 차별입니다. 학생을 지도하는 입장에 있는 강사가 이러한 발언을 한다는 것은 언어도단입니다.

 학생을 차별로 몰아넣은 결과, 학생의 정신상태가 악화해, 자살 등으로 이어졌으면, 어떻게 책임을 질 생각일까요?

 

 교육기관인 이상, 학교는 앞서서 차별이나 갑질로부터 학생을 지켜야 합니다.

이러한 상황에 대해, 저희(Moving Beyond Hate)는 도쿄국제일본어학원에 대해, 이하의 것을 청합니다.

O차별 발언을 한 강사를 해고하고, 그 외에도 이러한 차별이 있었는지에 대해 내부조사를 행할 것.

O 이러한 일이 두 번 다시 일어나지 않도록, 내부에서 차별금지 대책을 제정해, 재발방지를 위해 노력할 것.

 또한, 유학생에게 해당 학교를 소개하는 기관도 이러한 차별・갑질(하라스먼트)을 묵인 하지 않고, 비판할 책임이 있다고 생각합니다.

 따라서, 해당 학교에 학생을 소개하고 있는 해외의 유학 기관에 대해서는 이하의 것들을 청합니다.

O해당 교사를 해고해, 적절한 재발 방지 조치를 취할 때 까지 해당 학교를 학생에게 소개하지 않을 것.

O Moving Beyond Hate 와 함께 해당 학교의 차별에 반대할 것.

 최근, 유학생의 ‘실종’이나 ‘유학생 비지니스’라는 일본어 학교의 소홀한 관리, 교육 문제가 주목받고 있습니다. 하지만, 이것들은 정부가 진행해 온 유학생 유입 계획 하에서는 방치되어 왔습니다.

 또한, 일단 일본에 온 유학생의 재류 자격의 연장 여부에 대해서는 일본어 학교의 성적과, 출석률 등을 기반으로 해 입국관리국의 심사에 의해 결정됩니다. 즉, 학교와 입국관리국이 학생의 재류 자격의 연장의 여부를 결정하는 이러한 상황에서는 유학생이 차별에 대해 발언하는 것에 대해 여러 어려움을 동반합니다.

 그럼에도 불구하고, 제보자는 용기를 내어 저희들 Moving Beyond Hate 에 연락해 주셨습니다. 저희들은 유학생의 불리한 상황에 닥친 매우 악질적인 갑질(하라스먼트)에 대해, 단호하게 ‘NO!’를 외칩니다.

東京國際日本語學院（東京都新宿區）的老師在2020年1月的授課期間，對著患有精神疾病的留學生發表了在日本看醫院是給日本添麻煩，有病的話請回國這樣的言論。 （下面是學生的錄音）

「果然作為日本人的基本意見，和你是哪裡來的人毫無關係。有病的話請回國。這是誰都會提的意見⋯（省略）這有很多瞄準了（醫療）的壞人，即使你說你沒有這種想法，那也⋯」

「最近很多外國人拿到了留學簽證在日本接受醫療這件事都變成了社會問題」

「這樣的話你來日本根本沒有獨立，不如說在當日本稅金吸血鬼吧？你不這麼覺得嗎？」

通報者說明了有必要自己需要去醫院，但教師全部將此否定了。然後一邊表明了「對待外國人的醫療是完全在吸日本的稅金」這種毫無關係的偏見，一邊進行騷擾。

以障礙為理由否定了學生學習的權力，因為你是外國人所以就回國治療等催促是明確的障礙者歧視、外國人歧視。本應站在指導學生立場上的講師做出了這種發言，真是毫無道理。

而因為歧視對待、逼迫學生，將學生的精神狀態惡化或者導致自殺的情況下，又要怎樣負責呢？

作為教育機關，學校首先應該保障學生不受到騷擾。

 

所以我們對東京国際日本語学院有以下訴求。

・解僱歧視言論的講師，其他類似的歧視事件也請內部調查。

・為了防止再次發生這樣的事情，請內部指定禁止歧視規則並為了不再發生而做出努力。

 

另外，向留學生介紹本校的機構也不能忽視這種歧視和騷擾，也有責任批評這種行為。 因此，對向學生介紹本校的海外留學機構訴求如下：

・學校解雇講師，防止歧視再次發生而不向學生介紹本校。

・與Moving Beyond Hate一起反對本校的歧視行為。

 

近年來，留學生的「失蹤」、「留學生商業」等日語學校草率的管理、教育問題成為焦點。但是，這是因為政府推進的接受留學生計劃然後放任不管。

另外，來到日本的留學生能不能延長在留資格，要基於日語學校的成績和出席給入管審查決定。在學校和入管決定決定可以延長學生在留資格的情況這個背景下，留學生很難對歧視提出意見。

在這之中，通報者鼓起勇氣聯繫了我們Moving Beyond Hate。我們對於抓住留學生弱勢的非常惡劣的騷擾，堅決並且強硬地說「NO！」 大家一起發聲、吶喊吧！

¿Cuál es nuestro objetivo?
Lograr el despido de un docente cuyas declaraciones, realizadas en horas lectivas, constituyen en sí
mismas un acto discriminatorio contra los extranjeros. De la misma forma, buscamos que se pongan
en práctica una serie de medidas para que incidentes así no se vuelvan a repetir.
Sobre el incidente que nos ocupa
El incidente que nos ocupa se remonta a enero del pasado año 2020, cuando en la “Tokyo
international japanese school” (ciudad de Tokio, distrito de Shinjuku) una profesora invitó a una
alumna suya que padecía una enfermedad mental poco frecuente a abandonar el país, bajo pretexto
de que su enfermedad suponía una carga económica inaceptable para la seguridad social japonesa. A
continuación se exponen las declaraciones de la docente, transcritas a partir de la grabación:
“Los japoneses lo tenemos claro... independientemente de cuál sea tu nacionalidad, si estás enferma,
vuélvete a tu país. Vamos, creo que es lo lógico. [...] De entre tanta gentuza que viene a Japón para
recibir tratamiento médico... ¡A ver si vas a ser tú la excepción!”
“¿Qué pretendes viniendo a Japón en una situación de indefensión así? ¿Qué te parece el hecho de
que vengas a consumir el dinero de nuestros impuestos? ¿No dices nada?”
A pesar de que la estudiante repitió incansablemente que sus visitas al hospital eran cruciales para
su salud, la profesora continuó atacando y cuestionando sus motivos. El argumentar que “el
tratamiento médico de los extranjeros está chupando los impuestos de los japoneses” constituye en
sí un prejuicio, una necedad que inclina la conversación peligrosamente hacia el acoso. Tanto
argumentar malfunción o discapacidad para cuestionar el derecho a la libertad de cátedra de un
estudiante, como cuestionar el derecho de las personas a recibir tratamiento médico fuera de su país
es discriminación, contra la discapacidad y contra las personas extranjeras, respectivamente. El
hecho de que un docente se dirija así a un alumno en un centro educativo constituye asimismo un
abuso de poder indignante. Una actuación así puede además tener como consecuencia el
empeoramiento del estado de salud de la víctima, o incluso acabar en suicidio.
Qué exigimos a las partes involucradas con el agresor:
Desde nuestro punto de vista, la línea de actuación del centro educativo en el que ha tenido lugar
semejante incidente ha de ser la de proteger al alumnado del acoso y la discriminación. Es por ello
que reclamamos al centro lo siguiente:
1- El despido fulminante del docente que ha incurrido en tales declaraciones.
2- Que se abra una investigación interna en lo tocante al racismo en el centro.
3- La implantación de una normativa antirracista, y que se instaure un sistema que permita evitar
que se sucedan incidentes similares.
De la misma forma, aquellas instituciones o empresas de las cuales esta escuela se vale para reclutar
alumnos extranjeros (y en general todas las partes involucradas en el reclutamiento de alumnado
extranjero) son igualmente responsables, y habrán de condenar estos hechos sumamente
lamentables. Es por ello que reclamamos a todas las partes implicadas en el reclutamiento de
estudiantes extranjeros lo siguiente:
1- Exigir a la escuela el despido del docente, y dejar de reclutar para esta entidad hasta que la
misma no haya elaborado e introducido las normas para prevenir incidentes futuros.
2- Oponerse junto a nosotros, Moving Beyond Hate, al racismo en las escuelas, y en concreto a este
incidente.
Sobre el trasfondo del incidente
En estos últimos tiempos las “desapariciones” de alumnado extranjero y otros problemas derivados
del “negocio de los estudiantes extranjeros” y de la opacidad e irresponsabilidad que suele
acompañar a semejantes actividades económicas se ha convertido en un verdadero problema social.
A pesar de ello, el gobierno japonés continúa sin prestar atención a los excesos que se cometen bajo
las actuales leyes que permiten la entrada de alumnado extranjero. Además, una vez en el interior
del país, la renovación de la documentación que permite al estudiante permanecer de forma legal en
el archipiélago está en manos de la administración de las escuelas y del ministerio de inmigración.
Que se efectúe o no la renovación de dicha documentación depende del boletín de notas y ratio de
asistencia a las clases de cada alumno, así como del juicio del ministerio de inmigración en base a
los documentos anteriormente citados. En una situación en la que la escuela y el ministerio de
inmigración deciden si se renovará o no la documentación que permite a un alumno extranjero
permanecer legalmente en Japón, que el alumnado sea objeto de discriminación y acoso es cuanto
menos, problemático. Aún así, a pesar de las presiones, el alumnado se ha levantado y nos ha
contactado a nosotros, Moving Beyond Hate, para denunciar los abusos. Bajo ningún concepto
aceptaremos que esta situación, en la que se ejerce discriminación y acoso contra una persona en
evidente posición de debilidad quede impune, y nos oponemos frontalmente a estos fenómenos.
Sólo unidos, podemos acabar con este fenómeno depredador.
