Sunil C. est un journaliste bangladais issu de la minorité hindoue. La présence du parti politique islamique « Jamaat-e-islami » dans le gouvernement rend la situation des communautés religieuses minoritaires plus vulnérables. Amnesty International, Human Rights Watch, Reporters Sans Frontières et l’ONU dénoncent la violation constante des droits humains dans cet État, en particulier la liberté d’expression.

En 2011, Sunil dénonce aux journaux ainsi qu’à la police la présence d’individus fabriquant des bombes dans une maison. Il est alors kidnappé, puis libéré en échange d’une rançon et enfin, menacé de mort.

Craignant pour sa vie, il est alors contraint de fuir le pays, vers l’inconnu, abandonnant ses deux jeunes enfants, sa femme qui lutte aujourd’hui contre un cancer du sein, sa mère malade ainsi que son emploi. Il arrive en Suisse en janvier 2012 et demande l’asile, lequel lui a été refusé, Berne considérant que les violences ne sont pas du fait des autorités Bangladaises. Depuis plus de 10 ans, Sunil C. se bat pour que sa cause soit entendue, en vain. Il travaille dans la restauration depuis 2014, il est indépendant financièrement, et a même remboursé l’aide sociale qu’il a perçue en arrivant en Suisse. Il entretient d’excellentes relations avec les personnes qui l’entourent, ce qu’affirme également son employeur, un restaurateur genevois réputé, ainsi que la coprésidence du Parti Socialiste de la Ville de Genève qui le soutiennent. Il n’a aucune dette et a un casier judiciaire vierge.

Depuis le début de cette année, la vulnérabilité des minorités hindoues s’est aggravée au Bangladesh et Sunil espère de tout cœur que sa demande de reconsidération aboutisse au vu de la situation actuelle. Sunil risque de se faire arrêter dès son arrivée, et il encourt des conditions de détention contraires aux principes du Pacte international des droits civils et politique. Un rapport récent du Comité contre la torture l’ONU fait état d’arrestations illégales et de répression contre des personnes, notamment les journalistes et les défenseurs des droits humains, qui osent s’exprimer contre le gouvernement actuel. Il y dénonce également l’impunité des tortionnaires au Bangladesh.

Aujourd’hui, Sunil se trouve en détention administrative en vue d’un renvoi forcé au Bangladesh, prévu le 11 juillet 2022, alors même qu’il risque la répression de ses opposants et du gouvernement à son retour. Sa détention sera examinée devant le Tribunal administratif de première instance vendredi à 9h30 au Palais de justice à Genève.

Sunil C. is a Bangladeshi journalist from the Hindu minority. The presence of the Islamic political party Awami League in the government makes the situation of minority religious communities more vulnerable. Amnesty International, Human Rights Watch, Reporters Without Borders and the UN denounce the constant violation of human rights in the state, particularly the violations of the freedom of expression.

In 2011, Sunil reported to the newspapers and the police the presence of individuals making bombs in a house. He was then kidnapped, his life was threatened until he was released for ransom.

Fearing for his life, he was forced to flee the country, leaving behind his two young children, his wife who is now battling breast cancer, his sick mother and his job.

He arrived in Switzerland in January 2012 and applied for asylum, which was refused, since theFederal immigration authorities considered that he was not persecuted by the Bangladeshi government.

For more than 10 years, Sunil C. has been fighting for his cause. He has been working in the restaurant business since 2014, is financially independent, and has even repaid the social assistance he received when he arrived in Switzerland. He has excellent relations with the people around him, which is also confirmed by his employer, a well-known Geneva restaurant owner, as well as by the co-president of the Socialist Party of the City of Geneva, who support him. He has no debts and no criminal record.
 
Since the beginning of this year, the vulnerability of Hindu minorities in Bangladesh has increased and Sunil, a Hindu Brahman, is praying that his request for reconsideration will take into consideration the political situation in Bangladesh and how he is particularly affected by it as a Hindu Brahmin and a journalist.

Sunil is at risk of arrest upon arrival, and faces conditions of detention contrary to the principles of the International Covenant on Civil and Political Rights. A recent report by the UN Committee against Torture describes illegal arrests and repression of people, including journalists and human rights defenders, who dare to speak out against the current government. The report also denounces the impunity of torturers in Bangladesh.
 
Today, Sunil is in administrative detention in view of being sent back forcibly to Bangladesh on 11 July 2022, even though he risks torture, and a life sentence (if he survives) upon his return.
 
Sign the petition to show your support for Sunil and to demand that the Geneva government releases him immediately and postpones his forced departure to Bangladesh, at least until a final decision is made on the humanitarian permit he has requested.
