We, the Barngarla People, Traditional Owners of the lands proposed to be used, have brought a legal challenge to the Federal Court of Australia to fight tooth and nail against the Federal Government’s decision to build a Nuclear Waste Dump in Kimba, South Australia. This Government decision goes entirely against the unanimous views expressed by the First Nation’s People of the region.

The Government’s process of declaring Kimba as the dump site was flawed from the beginning. Despite being Native Title Holders, we never received the right to vote in the official ballot used to assess broad community support. We should have been consulted and listened to.

The Government then tried to remove the free and fair judicial review, by amending the National Radioactive Waste Management Act 2012. We were able to fight and protect our right to judicial review, and we now must fight again to reverse this terrible decision. 

While Government claims the waste is low level, we know that radiation leaks after a number of years, and they cannot guarantee its safety. This facility poses a significant risk to the environment, wildlife, and sacred areas that hold great significance to our people. 

Dumping radioactive waste on First Nations Land without free, prior, and informed consent is a gross violation of our rights and undermines Australia's commitment to reconciliation. It is crucial that our voices are heard and concerns are taken seriously.

We demand the proposed nuclear waste dump on Barngarla land in Kimba be halted and call for meaningful consultation with Traditional Owners to find a solution that respects our rights and ensures the safety of all Australians. This includes exploring alternative sites for the waste dump that do not infringe upon the rights of Indigenous people. 

We want to preserve what is left of our land. We are going to fight this all the way. Keep your waste dump off our country.
