The Issue

"I have likely represented over 1,000 clients... Never have I seen…  a case so flawed… and a witness whose statements and sworn testimony are so probably false... I don't say this lightly, but the DA's Office…  has continued to defend [Wendy Parris] in a way that is unprecedented... Even more bizarre… Themba Kelley has repeatedly been the target of baseless prosecutions as far back as 2013." -- Declared under penalty of perjury by Defense Attorney, Westbrook Johnson, before she passed away

   "From the Reconstruction through the first half of the twentieth-century, claims that Black men raped White women triggered countless lynchings, riots and sometimes massacres of Black people. Those horrors have stopped, but the fears and biases that fed them have not disappeared. It should be no surprise that racial bias and outright racism also play a role in wrongful convictions for sexual assault [today]." National Registry of Exonerations (2022) 

       On August 14, 2019, at around 4 am, Wendy Parris, who (admittedly) was raised to hate Black men and not to hang out with " colored people," alleged, that Themba Hasaan Kelley "broke my arm" and "threatened me with a gun," and that was why she submitted to rape. That was all a lie. 

·         Shortly after (covertly) alleging, he "broke my arm," an x-ray revealed "significant callous" and an old break. Not just that! When confronted, Parris admitted "that the arm had been broken in a car crash earlier that year." See Legacy Mt. Hood Medial Record Page 136. She was also (caught on film) using the "broken arm" normally, directly before and after she made the allegation. See film evidence @79lies.com 

·        Because Parris also alleged, that Themba Kelley "had just" raped her at "gunpoint" and was still inside the room "armed with the gun," the police pointed guns at the door. However, after Themba was arrested and they "searched all hiding locations inside and outside the room" according to police testimony, "there was no gun" and neither was there any evidence that "a gun or gun pieces or parts were in Room # 208." ·        That said, because, both primary elements of " forcible compulsion," the arm and gun, were proved to be false (on the same day of the arrest), the state had to know that Wendy Parris was lying about being " forced " to have sex. Still, they forged ahead and presented those lies to the Grand Jury - 79 times. 

 "Innocent Black men are almost 8 times more likely than White men to be falsely convicted of rape [and] a substantial number of convictions that led to exonerations were marred by implicit biases, racially tainted official misconduct and, in some cases explicit racism [Finally,] most innocent Black defendants who were exonerated for sexual assault had been convicted of raping White women." National Registry of Exonerations (2022) 

·        That said, what began as an 11 Count indictment is blessfully down to only three! Six Counts were dismissed pre-trial, two were won at trial, and three remain (for appeal) because of the historic misconduct of Prosecutors Nicole Hermann, Anthony Dundan and Brian Davidson. It is important that all parties are held accountable.

We need to hold those in positions of power over other people’s lives accountable for their actions. It is disgraceful to think that we still have these kinds of injustices in our courts. We depend on being treated fairly and that simply isn’t happening.
