55000 diversity visas are waiting for selectees under tiered approach discrimination and limited time.

This is a global S-O-S call from us, DV2022 winners, demanding to get the processes to be started and carried out by DOS and KCC!

 

Who Are We?

We are the winners and victims-to be of DV2022 which is a

- time-sensitive process (due date is 30th September 2022)

- process blocked by Tiered approach

- process clogged by the backlog created during the pandemics.

We are the DV-2022 selectees who are looking forward to immigrate to the United States. We are the future immigrants and the citizens of the country, who want to contribute to American economy and increase the quality of life of the American nation by using our skills and abilities.

 

What do we ask for?

The lottery winners are demanding an acceleration/progress in the process done by KCC and finishing the tiered approach practiced by DOS as this tiered approach is the new discrimination among the future immigrants of the USA.

 

The Process;

DV Lottery has become a nightmare for the winners in the last two years (DV2020/DV2021) due to the pandemics. Especially in DV-2021, which is the worst fiscal year of all times, only 17308 visas were issued among 55000 visas! And we do not want to be victims of the same tragedy. Now that there has been a significant effect of the vaccination, Lottery winners cannot tolerate another year (DV2022) of disappointment with the hope to start their new lives in the USA. As a result of the courts held in previous years, the tiered approach was found to be unfair and given temporary verdicts against it by the court (September 9 / GoodluckvBiden case decision by Judge Mehta). Still, this unfair practice continues by DOS against Diversity Visa 2022 winners.

The Diversity Visa or Green Card Lottery is a type of US immigrant visa. Since 1990, by order of the US Congress, each year the US Department of State, in accordance with Section 203 (C) of the US Immigration and Nationality Act, draws a number of people to receive this type of visa by lottery, which ultimately leads to receiving a permanent residence card in the United States. The main applicant/winner and derivatives will get a visa if they meet the necessary conditions. For the 2022 Fiscal Year, the winners were announced by the US Department of State by releasing the results of the lottery visa.

It has been about a 6-months-period since the lottery results were announced and so far the Kentucky Consular Center (KCC) and the US Embassies around the world haven't interviewed anyone yet. We have reached the information of the first interview to be taken into action on the 1st November 2021.

While waiting for new interviews, the time has passed and it is already the end of October, and there is only ten or fewer interview news among DV lottery winners. Most of those interviews have been planned for December already and it is clear that KCC has just planned 10 interviews up to now.

Besides the Tier action by DOS, KCC also made the process more confusing by processing the documents in the chronological order rather than the case numbers. This also leads to another delay for the lower Case Number holders while making even the highest numbers Documentarily Complete. The Bulletin published by DOS says lower case numbers may get interviews, but KCC does not make those Lower Case number applicants' documents completed. That is another obstacle the DV2022 winners are facing.

With the 2020 and 2021 court orders for the reserved visas to be scheduled in the 2022 fiscal year, there will be a considerable workload as well. This will cause a massive accumulation of cases at later months down the road.

U.S. embassies and consulates are using a tiered approach to triage immigrant visa applications based on the category of immigrant visa as they resume and expand processing.

The tiered approach has been a destroyer for the diversity visa and the selectees. Placing diversity visa winners in Tier 4 is discrimination against winners. We have limited time to get our visa, and currently, consulates do not give interviews to diversity visa selectees.

Although Embassies have the capacity to process multiple cases simultaneously, assigning only 10 cases for the first two months seems irrational for the rest of the limited time we have. 55000 visas are waiting for selectees only for a very short period (fiscal year-2022). Selectees are suffering from the uncertain, hopeless process and from being discriminated against.

When will DOS/KCC or Embassies process our cases if not today?!
