Petition: We, the undersigned, call on Martin County State's Attorney, Thomas Bakkedahl, and Martin County Sheriff, William Snyder, to reopen the investigation into the deaths of Zale and Saxon Nairne and to pursue an investigation to prosecute Rodney Nairne and his friend Gregory "Marty" Watson for their negligence, which led to the tragic loss of these two innocent lives.

Background: Zale Dudas, 9, and Saxon Nairne, 7, tragically lost their lives in a swimming pool while under the care of their father, Rodney Nairne, and his friend Marty Watson. Despite being professional scuba divers, Rodney and Marty failed in their responsibility to supervise the children, allowing them to play unsupervised in a pool, and on top of that, with a scuba tank filled with 100% helium. This inexcusable act of negligence resulted in the children's deaths, yet no criminal charges have been filed against either adult. This petition seeks to rectify this grave injustice.

Legal Basis: Under Florida Statute 827.03 2(b), "A person who willfully or by culpable negligence neglects a child and in so doing causes great bodily harm, permanent disability, or permanent disfigurement to the child commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084." We believe that the actions of Rodney Nairne and Marty Watson meet the criteria for culpable negligence as outlined in this statute.

Prosecutor's Statement and Rebuttal: State Prosecutor Thomas Bakkedahl, after deciding not to pursue charges, stated, “At an extensive in-person meeting, our findings and conclusions were communicated to the children’s mother as well as her civil attorneys. During this meeting, my assistants answered questions and addressed concerns of the attorneys. Our hearts go out to all those who loved Zale and Saxon and while we completely understand their desire that someone be “held accountable,” unfortunately, that accountability cannot be found within the criminal justice system."

We respectfully disagree with Mr. Bakkedahl's assessment. The Florida statute cited above clearly outlines that culpable negligence resulting in great bodily harm, permanent disability, or permanent disfigurement to a child is a second-degree felony. Moreover, Mr. Bakkedahl has previously prosecuted parents for lesser negligence crimes resulting in their children's deaths, which underscores the inconsistency in his decision-making and highlights the need for a comprehensive re-examination and pursuit of justice for Zale and Saxon.

Why It's Important: The loss of a child is an unimaginable pain, made even more unbearable when justice is not served. Suzie Dudas, the mother of Zale and Saxon, has endured not only the loss of her children but also the pain of knowing that those responsible for their deaths have faced no consequences. It is crucial for the Martin County legal system, sheriffs office and the State of Florida to demonstrate that negligence resulting in the loss of life, especially that of children, will not be tolerated. Reopening this case and pursuing charges against Rodney Nairne and Marty Watson will send a strong message that such acts of negligence are unacceptable and will be met with the appropriate legal response.
