The Supreme Court is poised to reverse Roe v Wade, which will also destroy the legal basis for your right to contraception.

But, if the Equal Rights Amendment (#ERA) is published in the Constitution, it can be used as a basis for a “fundamental right” to make your own reproductive choices. The 6 (of 9) conservative Supreme Court Justices do not believe there is any provision in the Constitution that provides a legal basis for a “fundamental right” to control your own reproductive choices. The basis in Roe is gleaned from implications of liberty and privacy that are gleaned from various provisions in the Constitution. So, honestly, it is a strained legal argument. But, the ERA can provide a more direct legal basis.

So, the lawyers can submit new legal arguments based on the ERA to the Supreme Court.

The ERA was legally ratified on 1/27/20, and the U.S. Archivist was ordered by law to publish it immediately in the Constitution as the 28th Amd [1 USC §106b], but Trump & his Attorney General Bill Barr intentionally BLOCKED him from publishing it with a legal opinion from the Dept. of Justice’s Office of Legal Counsel [“OLC Opinion”]!

The Archivist recently said that he would be honored to publish the ERA! & He also said (contrary to the press release the Trump Admin put out in Jan. 2020) that he will NOT require a COURT ORDER to publish the ERA in the Constitution. (There have been two federal cases seeking such an order for almost 2 yrs).

But Pres. Biden is the Archivist’s boss, & he can direct the Archivist to publish the ERA with a phone call or an Executive Order. I drafted a proposed Exec. Order adobe.ly/3dymKDF which you can read in the blogpost below.

The ERA says that no gov’t can discriminate based on sex, & the historical reason for laws that discriminate against women is because only women can give birth.

So, to truly be equal, as the ERA promises, women must have a fundamental right to make their own reproductive choices.

It wasn’t until contraception was widely available that women could go out and work and made significant gains in education and professions. But women still do not have equality in numbers or in pay, even though we are 51% of the population. For example, women only hold about 25% of the seats in Congress and in state legislatures. We don’t have equal pay for equivalent or equal work.

The ERA will also be able to be used to fight against other laws that treat women differently than men. If you look at my blogpost ftom 10/6/21, it lists many problems the ERA will be able to help fix.

Please post this widely on your groups! We need to demand that Pres. Biden PUBLISH THE ERA NOW!!

You can call your Senators & Representatives & ask them to tell Pres. Biden to direct the Archivist to publish the ERA at the Capitol Switchboard (202) 224-3121. Or write them!

There is nothing else we can do to save our constitutional fundamental right to our own reproductive choices, except HOPE or PRAY that 2 of the 6 conservative Justices protect & respect Roe. Chief Justice Roberts might be one, but it’s not realistic to think any of the other anti-Roe Justices will join him.
