Pass H.R. 1208 & S. 563 (118th Congress) for a Clean Carcieri Fix
Why this petition matters
Lets get H.R. 1208 AND S. 563 passed. (118th Congress)
BACKGROUND:
On February 24, 2009, the U.S. Supreme Court decided against land-into-trust rights for any Native American tribes who obtained federal status AFTER the Indian Reorganization Act was passed in June of 1934. This misguided ruling in the Carcieri v. Salazar case, given by Clarence Thomas, prohibits the Department of the Interior from placing tribal lands into federal trust status, leaving tribal lands under state, city/town and other local jurisdiction, if the tribe did not gain any form of federal status until after the IRA passed in 1934. This causes obstacles to federally recognized tribal communities. Several attempts to correct this matter have usually stalled once getting to the U.S. Senate. Now that the new 118th Congress has arrived, we need to start from scratch yet again. Now that both the House and the Senate have presented a bill to the floor, we need to pass them and finally get the other body to pass them along to the President's desk to be signed into law once and for all. This is doable and only one of them needs to get through, but this gives the Carcieri fix two chances. It's shameful, yet typical, that it hasn't already been rectified by the U.S. government.
