Landlord together with BMC has declared the residential building of 3 storeyed, 24 flats in total out of which 14 flats belong to the Landlord which is completely vacant as C1. Reaudit done by tenants side which was C2B, even the auditor is ready to give undertaking that the building is safe to stay yet TAC has declared the building to be dilapidated.

This matter is about the building in Chembur East, 16th road, CTS 980, plot no. 110, Mumbai 400071.

Landlord and BMC together are misusing the powers and making very old tenants, more than 50-60 years old or more, residents homeless. Declaring either illegal occupants, not providing alternative accommodation and depriving from the tenancy rights. Flats are purchased in pagadi system back in 1960's or before are purposely declared dangerous to remove very old occupants for Landlord's pervert and Ill intentions. 

Due to which, where would innocent family go? BMC showcases the power granted to them through Hon'ble High Court writ petition 1135 of 2014, which empowers BMC to evict the property with police force but what about the occupiers and tenants, where would these innocent tenants go as in Mumbai City it is very difficult to own a flat. There are senior citizens, small children studying in the school. Where would they relocate to as Landlord has cunning intentions to grab the property unlawfully.

While empowering rights to BMC, Alternative accommodation has been mentioned for govt and bmc properties however private Landlord's are exploiting old and lawful tenants and forcefully evicting them.

And hence, there is an urgent need to modify the law passed by Hon'ble court to not only protect old tenants and their houses but also to introduce law in favour of tenants and occupier of old pagadi system structure. To safeguard their homes, have alternative accommodation, safe from getting exploited by Landlord,  BMC and it's govt. and also punish such cunning Landlord's and BMC officers who has done human rights violation.

We urgently file a petition for justice and saving so many houses in Mumbai who are under scrutiny of Landlords together with BMC.
