لأجلِ الحَقيقة … وإحقاق الحقّ وحُقوق الشعب اللبناني 

 

كَشَف تقرير شَركة "الفاريز ومارسال" عن عَمليَّات نَهب وهدر وسوء ادارة من خِلال مصرف لبنان بقيمة ١١٥ ترليون ليرة تُوازي قَبل اندِلاع الأزمة ٧٦ مليار دولار، وهي مُجمَل كُلفة هندَسات ماليَّة موَزَّعة ما بَين ٨٥ ترليون ليرة كُلفة الهندَسات و ٣٠ ترليون ليرة دُفِعتْ عَلاوات على سَنَدات خزينة وعلى شهادات إيداع (صفحة ٨٨).

 

وبَيَّنَ التقرير بأنَّ فَجوة مصرف لبنان بالعُملات الاجنبيَّة، وخِلافاً لِما راحَ يَدَّعيه كثيرون في حِينه، كانت ٧١،٩ مليار دولار بنهاية العام ٢٠٢٠ (صفحة ١٤)، هي مِن أموال المودِعين، وقَد إزدادت لتَتَجاوز راهِناً ٧٧ مليار دولار، ما يُساوي تقريباً كُلفة مُجمَل تلكَ الهندَسات. وكَشَف التقرير عن تزوير فاضِح في حِسابات مصرف لبنان.

 

كلّ هذه الأرقام والمُمارَسات الاحتياليَّة التي تمَّ الكَشف عنها، تؤكِّد الحَجم الهائِل للسَرِقات والهدر في مصرف لبنان وعَبرِه. كذلك، تُظهِرُ بوضوح أبرَز مصادِر خِساراته التي أدَّتْ مع غَيرِها من المُسَبِّبات الاقتِصاديَّة والسِياسيَّة المَعروفة، بالإضافة إلى مَنظومة الفَساد المُتَجذِّرة وسُوء الحَوكَمة، إلى الانهِيار الكَبير وإفقار مُعظم اللبنانيِّين. 

 

إنَّها جَريمة العَصر الماليَّة بحَقِّ الوَطَن دولةً وشَعباً، وسُكوتُ القضاء والبرلمان والمَسؤولين السِياسيِّين عنها جَريمةٌ أكبَر. لَطالَما حَذَّرَت تقارير البَنك الدولي وصُندوق النَقد الدولي من هذه الارتِكابات الجرائِميَّة غَير المَسبوقة التي وصَفَها تقرير لَجنة حُقوق الانسان في الأمَم المُتَّحِدة بأنَّها "إفقارٌ مُتَعَمَّد للشَعب اللبناني". 

 

ولَمَّا كانَ تقرير الشَركة المُولَجة بالتَدقيق قد ذَكَر أنَ مصرف لبنان رَفض أنْ تتَواصَل الشَركة مع موَظَّفيه، وحَجَب عَنها الكثير مِن البيانات الأساسيَّة والمَعلومات (الفقرة ١.٤ ص ٩-١١)، مما يؤَدّي الى التَعمية على الجَرائِم الماليَّة المُرتَكَبة،

 

بالتالي، على ضَوء كُلّ ما تقدَّم، 

 

والتِزاماً بالقانون والشَفافيَّة وبِحَقِّ الناس في الوصول إلى المَعلومات، يُفتَرَض بمصرف لبنان كَشف كلّ الحَقائق والوقائِع وتسليم كلّ البيانات والمَعلومات، التي طلبَتَها شَركة التَدقيق الجِنائي ولَمْ تَحصل عليها، إلى الجهات الرَسميَّة والقضائيَّة المختصَّة، والإعلان عن أسماء جَميع المُستَفيدين من هذه التَجاوزات والهَرطَقات الماليّة التي أدَّتْ بِما أدَّتْ إلَيه إلى سَلْب الناس مُعظَم ودائِعِهم. 

 

لِذلك، نُطالب حاكِم مصرف لبنان بالتَكليف ونُوَّاب الحاكِم بالإفراج عن كامِل المُستَنَدات والمُعطيات المَطلوبة وذلك، انسجاماً مع المبادىء التي عَبَّروا عَنها والوعود بالشفافيَّة والحوكَمة الرَشيدة التي أطلَقوها … فالحَقُّ لا يتَجَزَّأ.

 

كما نُطالب نوَّاب الأمَّة وقُضاتها بالقيام بواجِبِهم بالمُساءَلة والمُحاسَبة وُصولا لإعادة الحُقوق الماليَّة لأصحابِها ولمُحاكَمة المَسؤولين عن هذه الارتِكابات وغيرِها.

 

فإذا لَم تنكَشِف الحَقائق كاملةً بالأسماء والأرقام، سنَبقى أسرى الشِعارات والقِراءات السياسيَّة العَقيمة والمُنحازة. 

مِن الحَقيقة الموَثَّقة يبدأ إحقاقُ الحقّ. وإحقاقُ الحقِّ آتٍ، حَتمًا لا مَحال.

In the name of truth... and the rights of the Lebanese people

 

The Alvarez & Marsal preliminary report recently issued revealed a failure of governance, waste, and pillage organized through the Central Bank of Lebanon, worth 115 trillion LBP, or $76 billion at the time. This is the overall cost of the so-called financial engineering, divided between 85 billion LBP (cost of engineering) and 30 billion LBP (paid in the form of bonuses on Treasury bills and certificates of deposit) - cf para. 5.7 of the report, “Costs of financial engineering”, sp. p.88.

 

Similarly, the report establishes that the Central Bank of Lebanon’s losses in foreign currencies amounted to $71.9 billion at the end of 2020 (Para. 2.1.4., Table 2.1, “Key findings”, sp. p.14), contrary to the assertions of many officials and others at the time, and that these losses have currently exceeded $77 billion, which is roughly equivalent to the overall cost of financial engineering established by the report. The report also revealed flagrant fraud in the accounts of the Central Bank. 

 

These figures, confirmed today and long concealed through the manipulation of records as indicated in the report, confirm the considerable extent of the failure of governance, waste, and pillage of depositors' savings within and through the Banque du Liban. They reveal the most important sources of the losses, which combined with the other well-known economic and political causes, deep-rooted corruption, and lack of governance, led to the great collapse.

 

This is the financial crime of the century against the Lebanese people and state, yet the inaction of the judiciary, parliamentary, and executive authorities in this regard constitutes an even more serious crime. Reports from the World Bank and the International Monetary Fund have always warned against these unprecedented criminal acts, that the report of the United Nations Human Rights Committee describes as "deliberate impoverishment of the Lebanese people”. 

 

Given that, according to Alvarez & Marsal report, the Central Bank of Lebanon refused access of the auditing firm to its employees as well as access to a substantial part of data and information on this subject (see para. 1.4 “Limitations”, pp.9-11 of the report), thus concealing the full truth on the related financial crimes,

 

Considering the foregoing,

 

And in compliance with the law, under the right of access to information and the principle of transparency, the Central Bank of Lebanon is required to hand over all data and information that were requested and not obtained by the auditing company, to the relevant supervisory – parliamentary, judicial, and administrative – authorities.

 

Consequently, we hereby call on the Acting Governor of the Central Bank of Lebanon and the Vice-Governors, to release all the required documents and data, in line with the principles that they expressed and the commitment to transparency and good governance that they made, as truth is indivisible. 

 

We also call on members of Parliament and competent judges to carry out their duties to restore the financial rights of the people in making accountable the people responsible for these and any other violations. 

 

If the facts are not revealed in full, with names and figures, we will remain captive to sterile and biased political slogans and interpretations. The fully established truth, in names and figures, is indeed the key to justice. And justice shall be done.
