Ms. Dauber repeatedly has taken to Twitter to verbally assault women lawyers who represent controversial clients she dislikes.  In addition, some of her statements are so broad and shallow that can be read to imply that all men are rapists and abusers.

Ms. Dauber's conduct is undignified and unbecoming of a lawyer, particularly of a law professor.

To be clear, the issue raised in this petition is not about Ms. Dauber's exercise of her right to free speech to express her sexism, hatred, and prejudice toward all men and any woman with whom she disagrees.  Rather, this petition strongly objects to her conduct as a lawyer. 

(1) Ms. Dauber has failed to recognize the legitimacy of the existence of at least two sides in the legal process, and the fundamental principles that everyone, including people we may not like or approve of, is entitled to legal representation, and to due process of law.

(2) Ms. Dauber has belittled the vital role of lawyers in furthering justice and public interest by violating the human rights principle that a lawyer shall not be identified with the cause of her client in discharging her duties, and therefore shall not be attacked for representing controversial persons or those accused of a crime.

It is dangerous for the legal profession not to take notice of personal attacks on any lawyer for discharging her function, lest such attacks become acceptable and normal. Harassment of lawyers for the cause of their clients is a hallmark of repressive societies intended to ostracize, intimidate and discourage lawyers from representing controversial persons. The use of such tactics is deserving of censure.

(3) Ms. Dauber's conduct violates the ABA and the California State Bar guidelines on lawyer civility.  Her use of offensive language, and her vacuous, unsubstantiated character attacks add nothing of value to important public debates and reflect negatively on the profession.

We demand that Stanford Law School and the State Bar of California take all possible actions to censure and discipline Ms. Dauber for her ignorance and disregard of fundamental legal principles, and her uncivil conduct toward other lawyers. Nothing less than the reputation and credibility of the profession and its institutions are at stake here.
