Why this petition matters

Honorable Prime Minister of India,

Honorable Home Minister of India,

Honorable L G of Union Territory of Jammu and Kashmir

 

We appeal to Prime Minister of India and Union Minister for Home Affairs and L G of J&K to immediately put a stop on all such policies that contribute to Denial of Genocide of Hindus of Kashmir. After GoI formally accepted that Hindus of Kashmir were subjected to Genocide while explaining the ban imposed on JKLF and explicitly after release of Kashmir Files , Hon’ble Prime Minister on the floor of house said that an ecosystem was working to undermine the issue of Hindus of Kashmir. 

All such policies that contribute to Denial of Genocide of Hindus of Kashmir are in fact crimes against Humanity and should be immediately stopped.

 

We have no hesitation in stating that Internally Displaced Hindus of Kashmir are caught up between the forces that continue to perpetrate Genocide on them and the forces of Denial of Genocide. It is an irony that while Pakistan has been the cardinal provocateur of the Genocide against Hindus of Kashmir, Government of India during last three decades has been the primary motor behind their Denial of Genocide. 

 

The policies on the return and rehabilitation of internally displaced Hindus of Kashmir pursued by successive governments in the erstwhile state of Jammu and Kashmir as well as in the Centre have been the most brazen expressions of Denial of Genocide. These policies have actually been attempts to enter into a deal with the Muslim separatist fundamentalist class in Kashmir responsible for Genocide of Hindus in Kashmir. Such policies seek to hand over the victims of Genocide to a Muslim fundamentalist order that allowed genocide to happen. Making Hindus of Kashmir to vote in exile through postal ballot is one more ugly and ruthless expression of Denial of Genocide perpetrated on Hindus of Kashmir living in exile.

Our younger generation accepted the jobs because of two fundamental reasons primarily one due to adverse economic conditions and secondly we as a community wanted to contribute to the cause of nation building, most of them joined after 2014 as we have tremendous belief in the able leadership of Prime Minister but we feel as if we have been abandoned by our leadership.

 

Denial of Genocide of Hindus of Kashmir has not only been destructive to Hindus of Kashmir but has also led to spillover of Jihad into rest of India. Expansion of Islamist ideologies is taking place along the length and breadth of India. Demographic assaults are happening in numerous places across India and GoI and the political class of India has chosen to be willfully blind to these developments. Pan Islamist regimes with terrorist goals are widening there tentacles. Ignoring Genocide of Hindus of Kashmir is proving to be a suicidal approach and is pushing the whole nation to the brink of peril. 

 

The neutering of 370 and abrogation of 35 A along with the reorganization of the erstwhile state of Jammu and Kashmir into two Union Territories has dismantled the legal edifice of a Muslim State on the territory of secular India. The changes will bring peace and prosperity if the de facto edifice of this Muslim state is also dismantled. A web of formulations, perspectives and administrative approaches sustains this de facto Muslim state. Halfway Separatist Governance models and Denial of Hindu genocide constitute the cardinal expressions of this de facto Muslim state. Halfway Separatist Governance as well as Denial of Hindu Genocide has to be abandoned as policy approaches. Otherwise the new changes in Jammu and Kashmir are doomed to fail. A new order in Jammu and Kashmir cannot be built on the soil of old order. 

 

Therefore, We Demand….

 

1. Enactment of Genocide Prevention Bill:

A genocide bill should be enacted immediately. 

The Prevention of Kashmir Genocide and Atrocities Bill as proposed and submitted by Panun Kashmir to the Government of India may be taken as reference while enacting the Genocide Bill.

 

2.Initiation of formation of a tribunal:

As proposed in Genocide bill a tribunal be constituted and Nuremberg type trials be initiated at an earliest. The Constitution of tribunal, procedure of its appointments, ambit and jurisdiction of this Genocide tribunal is also envisaged in the bill along with the procedures to be followed and the methodology of recording evidence. The Tribunal if it feels, may constitute Special Investigations Team to assist in investigating the crimes of genocide.  

 

3.RETURN AND REHABILITATION:

 Return and Rehabilitation of the displaced Genocide victim has to be based upon the doctrine of non-refoulement and in accordance to the principles and guidelines laid down in resolution adopted by the General Assembly of United Nations on 16th Dec 2005.

As it is not only necessary but imperative as well to develop a victim-centred and victim friendly approach and should be a matter of priority.

 

4. One Place Settlement for Geo political foothold:

For return and Rehabilitation of Kashmiri Pandits we have to keep in mind that we are subject of continual Genocidal attrition from last seven centuries and to insulate rest of India from the inflow of Jehad, a creation of a Centrally Administered One Place Settlement for the displaced Kashmiri Pandits is needed. This Geo political foothold can achieve the objective of reparation. We demand and urge that this geo political foothold be created at an earliest and displaced persons from last seven centuries be facilitated to settle back in their homeland.

 

5.Relocation of PM package employees:

PM package employees may be relocated outside valley or Deployed/Attached in the Relief Commissioners Office Jammu in order to avoid further Genocidal/ Target killings of Hindus in the Valley. We urge the government to Revoke Unconstitutional bond signed by employees under S.R.0 412 which emphasizes bonded labour and delink the of Rehabilitation from the PM Package and declare it as economic package.
