We are petitioning the Secretary of Health and Human Services to add COVID-19 vaccines to the Vaccine Injury Compensation Program (VICP). Currently COVID-19 vaccines are excluded from this well established and properly funded program.

The PREP Act forces people with serious physical reactions to COVID-19 vaccinations to file a claim in the Countermeasures Injury Compensation Program ("CICP"). Unfortunately, the CICP lacks the protections of the legal system. There is no transparency, no court, no judge, no right of appeal to a higher court. A nameless government administrator reviews claims and decides compensation with no public oversight. People who file claims in the CICP cannot contest the decisions made by the administrators. These decisions are made in a black hole with no outside accountability.   

Moving COVID-19 vaccines to the VICP is important because the VICP operates within the legal system. It has transparency, a court, independent judges, a right to present evidence, and a right of appeal up to the Supreme Court. This system was established in 1986 and has a long track record of awarding compensation to vaccine injured people over the years. 

A recent article in The New England Journal of Medicine explained why COVID-19 must be included in the Vaccine Injury Compensation Program immediately.

Adding COVID-19 vaccines to the VICP is in the best interests of everyone. There is no opposition or ongoing political or public argument against this addition. There is only inaction. 

We ask the Secretary of Health and Human Services to take action now. Make this change to the Vaccine Injury Compensation Program to benefit all Americans during this pandemic.
