The Toms River community is outraged at the efforts of BASF and NJDEP to cram down the proposed BASF NRD settlement on our community based on a defective public notice that provided only 30 days to provide comments in violation of the statute that required 60 days. This created confusion in the community to the detriment of the community. We have serious concerns about the matter. Many of those concerns were expressed at a public Speak-Out held at Toms River HS on 1/25/2023 with NJDEP in attendance but not participating. 

The Toms River community demands that BASF and NJDEP hold a public meeting at the Toms River HS before the end of the comment period regarding the proposed NRD settlement and that knowledgeable representatives from BASF and NJDEP be in attendance to answer our questions. We make this petition pursuant to N.J.A.C. 7:26C-1.7(o), which obligates BASF and NJDEP to attend a public hearing when demanded by the community by petition of 25 or more community members. Below and attached are signatures of community members in support of this petition numbering many more than 25.
