The State of NH has failed Everly. NH is allowing this baby to go with the biological mother who she does not know and allowing her to go across country to Indiana where there is no plan in place to ensure Everly is protected and is in a safe place. Everly has not had any interaction with her biological mother in over 3 months. 

A GAL was appointed to Everly and the GAL recommended that Everly stay in NH in Angela's custody. The GAL advised it would be detrimental to Everly if she was ripped from the home she is in now and placed in the custody of the biological mother. The judge that last heard this case was never involved in any of the previous court proceedings. This judge was just placed and did not consider any of the events leading up to this new court proceeding. The judge completely ignored the recommendation and ordered that the guardianship be terminated. 

The judge that ordered this recently made a very bad decision in a case in November 2021 where she denied a woman's request for a restraining order and later the woman was shot in the head by the man she was trying to get away from. 

Here is a summary of what has gone on during Everly's life:

Everly is 3 years old and has been under the guardianship of my sister in law, Angela for 2 years and 3 months. 

In 2020 the biological mother had a case opened with DCYF in Indiana in regards to Everly, she fled the state and came to Massachusetts. 

Everly was dropped off by her biological mother at a "friends" house in Massachusetts and told her "friend" to get in touch with Angela and said "she will take her". When Angela arrived to save Everly, she was in a pitch black room with no bottle and screaming so hard and loud her whole face & body was red. The house where Angela picked her up had drugs everywhere throughout the house. Everly was in a dirty diaper and did not have any clean clothes. New clothes and other items were purchased right after picking Everly up because the biological mother left her with nothing. 

The biological mom is a flight risk and involves herself in very dangerous work. She is an active prostitute and surrounds herself with gang members and drugs. She has had over 20 documented domestic disputes with her significant others as well as her own mother and younger brother.

Once Angela saved Everly, about a week went by before the biological mom reached out to see how Everly was doing. Once Angela obtained guardianship of Everly it was almost as if the biological mom disappeared. There was no contact between the biological mom and Everly for at least a year. 

At 1 year after guardianship was granted, the matter was brought before the court to reunify Everly & the biological mother. The biological mom did not follow the courts order for reunification and has made very minimal attempts to get to know her daughter. 

The biological mother had 2 sons prior to Everly and her rights were terminated by the state of Massachusetts.  The sons are in the process of being adopted by another family member and are in a very safe home. 

If we are not able to keep Everly in the only home she has known her whole life, we will never be able to protect her and think the worst will happen. Please sign this petition to keep Everly in the loving home that she already has.
