There are as many as 2,000 homes in Massachusetts that can be affected by crumbling concrete foundation.

Private Insurance companies have denied homeowners’ claims to cover the cost of foundation repairs. In 2019, the Connecticut State Supreme Court ruled that homeowners’ insurance policies can exclude crumbling foundations under the existing definition of “collapse.”
Concrete used in homes in contained the mineral pyrrhotite, which degraded foundations. Without repairs costing $150,000 to $250,000, affected homes eventually would be uninhabitable. This bill would allow Massachusetts to set up a Captive insurance fund to assist homeowners who are plagued with this devastation and assist in the cost of repair. This legislation will also begin quarry testing standards so this will not continue to happen. It will help homeowners with standardized property tax abatements, and permit fee waivers. Disclosures by home sellers who know of any issues are included in the bill.
