Desmond Franklin was shot and killed by an off-duty police officer in Cleveland, Ohio on April 9, 2020.  The officer, Jose Garcia, has not been fired or charged.  

Garcia and Desmond had interactions in a parking lot immediately before hand.  Garcia questioned Desmond and the passenger with Desmond of their actions of taking items off a truck and used racial slurs.  Everyone returned to the vehicles and Garcia left and started driving down the street.  Desmond then pulled out of the parking lot too and started driving in the same direction, Desmond's car was passing Garcia's when Garcia shot Desmond. Desmond Franklin was just driving down the street when Garcia shot Desmond in the right side of his head, killing Desmond.    

Garcia never identified himself as a police officer, was not in uniform, and was not in a police vehicle.  Garcia shot Desmond in his head which is not where Cleveland police are trained to shoot.  There was no threat to Garcia's life or any other life.  Garcia is currently on paid leave.  This is not okay.  Garcia needs to be charged with murder.  There are many holes in Garcia's account of the case and it is clear that there was absolutely no reason for Garcia to shoot Desmond.  We must demand that Cleveland police be held accountable.  Sign this petition demanding that Prosecutor Dean Holman charge Garcia with the murder of Desmond Franklin.
