Letter to the Osaka High Court 12th Civil Division

We filed this lawsuit in order to clarify the real damage caused, and also the government and TEPCO’s responsibility for the Fukushima nuclear disaster. We urge that all victims need compensation and aim to prevent further nuclear disasters.

It has been over ten years since the nuclear disaster happened, but the damage continues to be inflicted. The accident itself has not been solved yet.

The nuclear disaster brought hardship and suffering to us. Although time is passing, it is not possible to be healed. There are many plaintiffs who are still traumatised and damaged mentally, physically and financially as time goes on. Some of them have died who couldn’t return to their home town and weren’t able to get a peaceful life back.

This difficult situation has been forced on us. Our poverty became more serious when housing support was ended in 2017. In any nuclear disaster, anyone can become victims and want to evacuate. Our evacuation was not abnormal. It was an inevitable action to avoid terrible radiation, especially to protect our children’s lives.

We strongly urge a fair judgement by looking clearly at our lives and the reality of the nuclear disaster. We hope the judges will listen to our poignant appeals and hear us expeditiously and properly.

In March 2011, the Fukushima Daiichi nuclear power plant exploded in Japan. Over ten years have passed, but the disaster hasn't ended yet. Still radiation is being released into the air and the ocean everyday. The radioactive contamination will not disappear for millions of years. Even now there are 40,000 evacuees in Japan (28 Sep 2021). But the Japanese government and TEPCO ( Tokyo Electric Power Company) haven’t taken responsibility for the disaster, and never recognised us as what the United Nations designates Internally Displaced Persons.


From 2013, 175 plaintiffs from 58 households who evacuated to Kyoto filed a suit in the Kyoto District Court to clarify the  damage and responsibility of the government and TEPCO and to prevent nuclear disasters ever happening again. The Damages Suit of The Fukushima Nuclear Disaster, Kyoto received a judgement on the 15th March 2018 at the Kyoto District Court. The judicial decision was positive and was a form of progress, because the right of some people to evacuate from outside the official area of the Government Interim Guidelines was confirmed. However the validity of some plaintiffs' evacuation was rejected. The defendants (The Japanese Government and TEPCO) appealed, therefore all the plaintiffs have also decided to appeal. And now the legal fight has reached the Osaka High Court. We request a fair judgement in this trial.
